  1                      A bill to be entitled

  2         An act relating to collegiate license plates;

  3         amending s. 320.08056, F.S.; exempting a

  4         collegiate specialty plate from the requirement

  5         to maintain minimum sales of 1,000 or more

  6         until the plate has been offered for a

  7         specified period; providing an effective date.

  8  

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Subsection (8) of section 320.08056,

12  Florida Statutes, is amended to read:

13         320.08056  Specialty license plates.--

14         (8)(a)  The department must discontinue the issuance of

15  an approved specialty license plate if the number of valid

16  specialty plate registrations falls below 1,000 plates for at

17  least 12 consecutive months. However, this requirement does

18  not apply to a collegiate license plate issued under s.

19  320.08058(3) until the plate has been offered 8 years. A

20  warning letter shall be mailed to the sponsoring organization

21  following the first month in which the total number of valid

22  specialty plate registrations is below 1,000 plates.

23         (b)  The department is authorized to discontinue the

24  issuance of a specialty license plate and distribution of

25  associated annual use fee proceeds if the organization no

26  longer exists, if the organization has stopped providing

27  services that are authorized to be funded from the annual use

28  fee proceeds, or pursuant to an organizational recipient's

29  request. Organizations are required to notify the department

30  immediately to stop all warrants for plate sales if any of the

31  conditions in this section exist, and must meet the

 1  requirements of s. 320.08062 for any period of operation

 2  during a fiscal year.

 3         Section 2.  This act shall take effect July 1, 2006.
