7An act relating to the personal needs allowance; amending
8s. 409.904, F.S.; increasing the monthly personal
9allowance for certain eligible persons; providing an
10appropriation; providing an effective date.

12Be It Enacted by the Legislature of the State of Florida:
13
14     Section 1.  Paragraph (a) of subsection (3) of section
15409.904, Florida Statutes, is amended to read:
16     409.904  Optional payments for eligible persons.--The
17agency may make payments for medical assistance and related
18services on behalf of the following persons who are determined
19to be eligible subject to the income, assets, and categorical
20eligibility tests set forth in federal and state law. Payment on
21behalf of these Medicaid eligible persons is subject to the
22availability of moneys and any limitations established by the
23General Appropriations Act or chapter 216.
24     (3)  A person who is in need of the services of a licensed
25nursing facility, a licensed intermediate care facility for the
26developmentally disabled, or a state mental hospital, whose
27income does not exceed 300 percent of the SSI income standard,
28and who meets the assets standards established under federal and
29state law. In determining the person's responsibility for the
30cost of care, the following amounts must be deducted from the
31person's income:
32     (a)  The monthly personal allowance for residents which
33shall be $45 per month as set based on appropriations.
34     Section 2.  The sums of $2,205,524 from the General Revenue
35Fund and $3,146,716 from the Medical Care Trust Fund are
36appropriated to the Agency for Health Care Administration for
37the 2006-2007 fiscal year for an increase in Medicaid
38expenditures, and the sum of $660,000 is appropriated from the
39General Revenue Fund to the Department of Children and Family
40Services for the 2006-2007 fiscal year for an increase to the
41personal care allowance.
42     Section 3.  This act shall take effect July 1, 2006.
