14 On page 1, line 10, through
15 page 2, line 7, delete those lines
16
17 and insert:
18 Section 1. Subsection (4) of section 796.07, Florida
19 Statutes, is amended, subsections (5) and (6) of that section
20 are redesignated at subsections (6) and (7), and a new
21 subsection (5) is added to that section, to read:
22 796.07 Prohibiting prostitution, etc.; evidence;
23 penalties; definitions.--
24 (4) A person who violates any provision of this
25 section, except as provided in subsection (5), commits:
26 (a) A misdemeanor of the second degree for a first
27 violation, punishable as provided in s. 775.082 or s. 775.083.
28 (b) A misdemeanor of the first degree for a second
29 violation, punishable as provided in s. 775.082 or s. 775.083.
30 (c) A felony of the third degree for a third or
31 subsequent violation, punishable as provided in s. 775.082, s.

1 775.083, or s. 775.084.
2 (5) A person who violates any provision of this
3 section within 1,000 feet of the real property comprising a
4 child care facility as defined in s. 402.302 that is in
5 compliance with the signage requirements for child care
6 facilities in s. 893.13(1)(c); a public or private elementary,
7 middle, or secondary school; or a physical place of worship
8 where a church or religious organization regularly conducts
9 religious services; or in, on, or within 1,000 feet of real
10 property comprising a state, county, or municipal park, a
11 community center, or a publicly owned recreational facility,
12 commits:
13 (a) A misdemeanor of the first degree for a first
14 violation, punishable as provided in s. 775.082, s.775.083, or
15 s. 775.084.
16 (b) A felony of the third degree for a second
17 violation, punishable as provided in s. 775.082, s.775.083, or
18 s. 775.084.
19 (c) A felony of the second degree for a third or
20 subsequent violation, punishable as provided in s. 775.082,
21 s.775.083, or s. 775.084.
