11  The Committee on Community Affairs (Lawson) recommended the
12  following amendment:
13  
14         Senate Amendment 
15         On page 1, line 23, through
16            page 2, line 7, delete those lines
17  
18  and insert:  
19         (b)  If a felony or misdemeanor violation of this
20  section was committed within 1,000 feet of the real property
21  comprising a child care facility as defined in s. 402.302 that
22  is in compliance with the signage requirements for child care
23  facilities in s. 893.13(1)(c); a public or private elementary,
24  middle, or secondary school; or a physical place of worship
25  where a church or religious organization regularly conducts
26  religious services; or in, on, or within 1,000 feet of real
27  property comprising a state, county, or municipal park, a
28  community center, or a publicly owned recreational facility,
29  the penalty shall be reclassified as follows:
30         1.  A misdemeanor of the first degree is reclassified
31  to a felony of the third degree.
