  1                      A bill to be entitled

  2         An act relating to prostitution; amending s.

  3         796.07, F.S.; providing for penalties for

  4         certain violations committed within a specified

  5         distance of certain locations; providing an

  6         effective date.

  8  Be It Enacted by the Legislature of the State of Florida:

  9  

10         Section 1.  Subsection (4) of section 796.07, Florida

11  Statutes, is amended, subsections (5) and (6) of that section

12  are redesignated as subsections (6) and (7), and a new

13  subsection (5) is added to that section, to read:

14         796.07  Prohibiting prostitution, etc.; evidence;

15  penalties; definitions.--

16         (4)  A person who violates any provision of this

17  section, except as provided in subsection (5), commits:

18         (a)  A misdemeanor of the second degree for a first

19  violation, punishable as provided in s. 775.082 or s. 775.083.

20         (b)  A misdemeanor of the first degree for a second

21  violation, punishable as provided in s. 775.082 or s. 775.083.

22         (c)  A felony of the third degree for a third or

23  subsequent violation, punishable as provided in s. 775.082, s.

24  775.083, or s. 775.084.

25         (5)  A person who violates any provision of this

26  section within 1,000 feet of the real property comprising a

27  child care facility as defined in s. 402.302 that is in

28  compliance with the signage requirements for child care

29  facilities in s. 893.13(1)(c); a public or private elementary,

30  middle, or secondary school; or a physical place of worship

31  where a church or religious organization regularly conducts

 1  religious services; or in, on, or within 1,000 feet of real

 2  property comprising a state, county, or municipal park, a

 3  community center, or a publicly owned recreational facility,

 4  commits:

 5         (a)  A misdemeanor of the first degree for a first

 6  violation, punishable as provided in s. 775.082, s.775.083, or

 7  s. 775.084.

 8         (b)  A felony of the third degree for a second

 9  violation, punishable as provided in s. 775.082, s.775.083, or

10  s. 775.084.

11         (c)  A felony of the second degree for a third or

12  subsequent violation, punishable as provided in s. 775.082,

13  s.775.083, or s. 775.084.

14         Section 2.  This act shall take effect October 1, 2006.
