11  Senator Argenziano moved the following amendment:
12  
13         Senate Amendment (with title amendment) 
14         On page 12, lines 3-23, delete those lines
15  
16  and insert:  
17         (4)  A noninstructional contractor who has been
18  convicted of any of the offenses listed in paragraph (2)(g)
19  may not be permitted on school grounds when students are
20  present, unless the contractor has received a full pardon or
21  has had his or her civil rights restored. A noninstructional
22  contractor who is present on school grounds in violation of
23  this subsection commits a misdemeanor of the first degree,
24  punishable as provided in s. 775.082 or s. 775.083.
25         (5)  If a school district has reasonable cause to
26  believe that grounds exist for the denial of a contractor's
27  access to school grounds when students are present, it shall
28  notify the contractor in writing, stating the specific record
29  that indicates noncompliance with the standards set forth in
30  this section. It is the responsibility of the affected
31  contractor to contest his or her denial. The only basis for

Florida Senate - 2006 SENATOR AMENDMENT Bill No. CS for CS for CS for SB 2280 Barcode 352334 1 contesting the denial is proof of mistaken identity. 2 (6) Each contractor who is subject to the requirements 3 of this section shall agree to inform his or her employer or 4 the party to whom he or she is under contract and the school 5 district within 48 hours if he or she is arrested for any of 6 the disqualifying offenses in paragraph (2)(g). A contractor 7 who willfully fails to comply with this subsection commits a 8 misdemeanor of the first degree, punishable as provided in s. 9 775.082 or s. 775.083. If the employer of a contractor or the 10 party to whom the contractor is under contract knows the 11 contractor has been arrested for any of the disqualifying 12 offenses in paragraph (2)(g) and authorizes the contractor to 13 be present on school grounds when students are present, such 14 employer or such party commits a misdemeanor of the first 15 degree, punishable as provided in s. 775.082 or s. 775.083. 16 17 18 ================ T I T L E A M E N D M E N T =============== 19 And the title is amended as follows: 20 On page 2, lines 8 and 9, delete those lines 21 22 and insert: 23 providing penalties; providing grounds for 24 contesting 25 26 27 28 29 30 31 2 1:15 PM 04/27/06 s2280.03cj.00b
