1 A bill to be entitled
2 An act relating to an accessory after the fact;
3 amending s. 777.03, F.S.; providing that if a
4 person maintains or assists the principal or
5 accessory before the fact, or gives the
6 offender any other aid, knowing that the
7 offender had committed the offense of leaving
8 the scene of an automobile accident, or had
9 been accessory before the fact, with the intent
10 that the offender avoids or escapes detection,
11 arrest, trial, or punishment, that person is an
12 accessory after the fact unless the court finds
13 that the person is a victim of domestic
14 violence; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:

18 Section 1. Paragraph (b) of subsection (1) of section
19 777.03, Florida Statutes, is amended to read:
20 777.03 Accessory after the fact.--
21 (1)
22 (b) Any person, regardless of the relation to the
23 offender, who maintains or assists the principal or accessory
24 before the fact, or gives the offender any other aid, knowing
25 that the offender had committed the offense of child abuse,
26 neglect of a child, aggravated child abuse, aggravated
27 manslaughter of a child under 18 years of age, or murder of a
28 child under 18 years of age, or leaving the scene of an
29 accident in violation of s. 316.027, or had been accessory
30 thereto before the fact, with the intent that the offender
31 avoids or escapes detection, arrest, trial, or punishment, is

1 an accessory after the fact unless the court finds that the

3 Section 2. This act shall take effect July 1, 2006.

6 SENATE SUMMARY
7 Provides that if a person maintains or assists the
principal or accessory before the fact, or gives the
8 offender any other aid, knowing that the offender had
committed the offense of leaving the scene of an
9 automobile accident, or had been accessory before the
fact, with the intent that the offender avoids or escapes
10 detection, arrest, trial, or punishment, that person is
an accessory after the fact unless the court finds that
11 the person is a victim of domestic violence.
