11  The Committee on Criminal Justice (Smith) recommended the
12  following amendment:

14         Senate Amendment 
15         On page 12, lines 30-31, and page 19, lines 20-21,
16  delete those lines

18  and insert:  commits the offense of refusal to submit to
19  testing. If such person's driving privilege was previously
20  suspended for a prior refusal to submit to a lawful test of
21  his or her breath, urine, or blood, such offense is a
22  misdemeanor of the first degree, punishable and is subject to
23  punishment as provided in s. 775.082 or s. 775.083. If such
24  person's driving privilege was not previously suspended for a
25  prior refusal to submit to a lawful test of his or her breath,
26  urine, or blood, such offense shall be punished by
27  imprisonment for not more than 6 months and if adjudicated
28  guilty, by a fine of up to $500.
