24  encouraged to establish appropriate interinstitutional
25  mechanisms to achieve cooperative planning and delivery of
26  academic programs and related services, share a high-cost
27  instructional facility and equipment, coordinate credit and
28  noncredit outreach activities, have access to each other's
29  library and media holdings and services, and provide
30  cooperative campus activities and consultative relationships
31  for the discussion and resolution of interinstitutional issues

Subsections (1) and (3) of section 1007.23, 3 Florida Statutes, are amended to read: 4 1007.23 Statewide articulation agreement.-- 5 (1) The State Board of Education shall establish in 6 rule a statewide articulation agreement that governs: 7 (a) Articulation between secondary and postsecondary 8 education, including credit earned through high school career 9 and technical education majors and career academies; 10 (b) Admission of associate in arts degree graduates 11 from community colleges and state universities; 12 (c) Admission of applied technology diploma program 13 graduates from community colleges or career centers; 14 (d) Admission of associate in science degree and 15 associate in applied science degree graduates from community 16 colleges; 17 (e) The use of acceleration mechanisms, including 18 nationally standardized examinations through which students 19 may earn credit; 20 (f) General education requirements and statewide 21 course numbers as provided for in ss. 1007.24 and 1007.25; and 22 (g) Articulation among programs in nursing; and. 23 (h) Admission of postsecondary vocational, technical, 24 or career certificate or diploma graduates from school 25 district career centers or charter technical career centers. 26 (3) The articulation agreement must guarantee the 27 statewide articulation of appropriate workforce education 28 development programs and courses between school districts and 29 community colleges and specifically provide that every applied 30 technology diploma graduate must be granted the same amount of 31 credit upon admission to an associate in science degree or 2 8:04 AM 03/20/06 s2326d-ed20-c7t

Preference for admission must be given 3 to graduates who are residents of Florida. By March 1, 2007, 4 the State Board of Education shall establish an articulated 5 career path for specific workforce education professions, 6 including, but not limited to, the program areas of criminal 7 justice, business, nursing, allied health, and early childhood 8 education. The career paths shall provide for the articulation 9 of: 10 (a) Credit earned in vocational, technical, or career 11 certificate or diploma programs to associate in science 12 degrees or associate in applied science degrees. 13 (b) Credit earned in associate in science degree 14 programs to credit in baccalaureate degree programs. 15 (c) Credit awarded by public and private institutions. 16 (d) Credit for experiential learning associated with 17 minimum training requirements for employment. 18 Section 3. Paragraph (a) of subsection (2) of section 19 1009.50, Florida Statutes, is amended to read: 20 1009.50 Florida Public Student Assistance Grant 21 Program; eligibility for grants.-- 22 (2)(a) State student assistance grants through the 23 program may be made only to degree-seeking students who enroll 24 in at least 6 semester hours, or the equivalent per term, or 25 students who enroll in a postsecondary career certificate 26 program of at least 450 clock hours, and who meet the general 27 requirements for student eligibility as provided in s. 28 1009.40, except as otherwise provided in this section. Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2326 Barcode 642600 1 of tuition fees and other registration fees for 30 credit 2 hours at state universities or such other amount as specified 3 in the General Appropriations Act, to any recipient. A 4 demonstrated unmet need of less than $200 shall render the 5 applicant ineligible for a state student assistance grant. 6 Recipients of the grants must have been accepted at a state 7 university, or community college, school district career 8 center, or charter technical career center authorized by 9 Florida law. A student is eligible for the award for 110 10 percent of the number of credit hours required to complete the 11 program in which enrolled, except as otherwise provided in s. 12 1009.40(3). 13 Section 4. Section 1009.521, Florida Statutes, is 14 created to read: 15 1009.521 GED Success Scholarship Program.-- 16 (1) The GED Success Scholarship Program is created to 17 establish a scholarship program to encourage students who 18 successfully complete a GED program to attend a program 19 offered by an accredited public or private technical or career 20 center or a community college program identified by the 21 Department of Education as a program that provides a career 22 path to one of the top 15 occupations in number of annual 23 openings as listed on the Agency for Workforce Innovation's 24 Florida Statewide Targeted Occupations List or on a regional 25 targeted occupations list at the time of the student's initial 26 enrollment. 27 (2) The scholarship program shall be administered by 28 the department pursuant to the requirements of this section 29 and rules of the State Board of Education. 30 (3) For each year in which funds are appropriated in 31 the General Appropriations Act, the department shall allocate 4 8:04 AM 03/20/06 s2326d-ed20-c7t

The scholarships shall be 3 awarded by the department on a first-come, first-served basis 4 to eligible recipients until all funds specifically designated 5 for the GED Success Scholarships for that fiscal year have 6 been allocated. 7 (4) A student who meets all of the following 8 requirements is eligible to receive a scholarship pursuant to 9 this section: 10 (a) The student is a Florida resident for tuition 11 purposes pursuant to s. 1009.21. 12 (b) The student has successfully completed all 13 sections of the GED tests. 14 (c) The student has enrolled in a program identified 15 by the department as a program in an accredited public or 16 private technical or career center or a community college that 17 provides a career path to one of the top 15 occupations in 18 number of annual openings as listed on the Agency for 19 Workforce Innovation's Florida Statewide Targeted Occupations 20 List or on a regional targeted occupations list at the time of 21 the student's initial enrollment. 22 (d) The student has submitted an application for the 23 scholarship to the department, in the manner prescribed by the 24 department, after December 1 for the following school year and 25 before June 1 of the year in which funding is requested. 26 (5)(a) Payment of GED Success Scholarships shall be 27 transmitted to the director or president of the eligible 28 institution, or his or her representative, in advance of the 29 registration period. Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2326 Barcode 642600 1 department by the established date the eligible students to 2 whom scholarship moneys were disbursed each academic term. 3 Each institution shall also report to the department necessary 4 demographic and eligibility data for such students. 5 (c) Each accredited private institution that receives 6 moneys through the GED Success Scholarship Program shall 7 prepare a biennial report that includes a financial audit, 8 conducted by an independent certified public accountant, of 9 the institution's administration of the program and a complete 10 accounting of the moneys allocated to the institution for the 11 program. The report shall be submitted to the department no 12 later than March 1 of every even-numbered year. 13 (6) The State Board of Education may adopt rules 14 pursuant to ss. 120.536(1) and 120.54 relating to the 15 administration of the scholarship program. 16 Section 5. Section 1011.802, Florida Statutes, is 17 created to read: 18 1011.802 School District Career Center Facility 19 Enhancement Challenge Grant Program.-- 20 (1) There is established the School District Career 21 Center Facility Enhancement Challenge Grant Program for the 22 purpose of assisting career centers in building high priority 23 instructional capital facilities consistent with s. 1001.44, 24 including common areas connecting such facilities. The 25 direct-support organizations that serve the school districts 26 may solicit gifts from private sources which are eligible for 27 state matching funds for capital facilities. For purposes of 28 this section, private sources of funds shall not include any 29 federal, state, or local government funds that a school 30 district may receive. 31 (2) The School District Career Center Facility 6 8:04 AM 03/20/06 s2326d-ed20-c7t
Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2326 Barcode 642600 1 Enhancement Challenge Grant Program shall provide funds to 2 match private contributions for the development of high 3 priority instructional capital facilities, including common 4 areas connecting such facilities, within the career centers. 5 (3) Within the direct-support organization of each 6 school district, a separate career center capital facilities 7 matching account must be established for the purpose of 8 providing matching funds from the direct-support 9 organization's unrestricted donations or other private 10 contributions for the development of high priority 11 instructional capital facilities, including common areas 12 connecting such facilities. The Legislature may appropriate 13 funds for distribution to a school district after matching 14 funds are certified by the direct-support organization and 15 school district to the Department of Education. The Public 16 Education Capital Outlay and Debt Service Trust Fund shall not 17 be used as the source of the state match for private 18 contributions. 19 (4) A project may not be initiated unless all private 20 funds for planning, construction, and equipping the facility 21 have been received and deposited in the direct-support 22 organization's matching account and the state's share for the 23 minimum amount of funds needed to begin the project has been 24 appropriated by the Legislature. The Legislature may 25 appropriate the state's matching funds in one or more fiscal 26 years for the planning, construction, and equipping of an 27 eligible facility. However, these requirements shall not 28 preclude the school district or direct-support organization 29 from expending available funds from private sources to develop 30 a prospectus, including preliminary architectural schematics 31 or models, for use in its efforts to raise private funds for a 7 8:04 AM 03/20/06 s2326d-ed20-c7t

Additionally, any private sources of funds expended 2 for this purpose are eligible for state matching funds if the 3 project is awarded grant funds under this section. 4 (5) To be eligible to participate in the School 5 District Career Center Facility Enhancement Challenge Grant 6 Program, a school district, through its direct-support 7 organization, shall raise contributions from private sources 8 equal to one-third of the total cost of a facility 9 construction project. After raising such contributions, the 10 school district shall be eligible for a match by a state 11 appropriation equal to the amount raised for a facility 12 construction project up to one-third of the cost of the 13 project, subject to the General Appropriations Act. Another 14 one-third of the total cost must be provided from the school 15 district's local capital funds. 16 (6) If the state's share of the required match is 17 insufficient to meet the requirements of subsection (5), the 18 school district shall renegotiate the terms of the 19 contribution with the donors. If the project is terminated, 20 each private donation, plus accrued interest, shall revert to 21 the direct-support organization for remittance to the donor at 22 the donor's discretion. 23 (7) By September 1 of each year, the State Board of 24 Education shall transmit to the Legislature, in the capital 25 outlay budget request, a list of projects that meet all 26 eligibility requirements to participate in the School District 27 Career Center Facility Enhancement Challenge Grant Program and 28 a budget request that includes the recommended schedule 29 necessary to complete each project. 30 (8) In order for a project to be eligible under this 31 program, it must be survey-recommended under the provisions of 8 8:04 AM 03/20/06 s2326d-ed20-c7t
Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2326 Barcode 642600 1 s. 1013.31, included in the school district's 5-year capital 2 improvement plan, and receive prior approval from the State 3 Board of Education. 4 (9) Any project funds that are unexpended after a 5 project is completed shall revert to the school district 6 direct-support organization's career center capital facilities 7 matching account. One-third of such unexpended funds shall be 8 reserved for the school district career center that originally 9 received the private contribution for the purpose of providing 10 private matching funds for future facility construction 11 projects as provided in this section. One-third of such 12 unexpended funds shall be returned to the General Revenue 13 Fund. One-third of such unexpended funds shall be returned to 14 the school district. 15 (10) The surveys, architectural plans, facility, and 16 equipment shall be the property of the participating school 17 district. 18 Section 6. (1) As part of determining the appropriate 19 courses and programs for statewide articulation, the Office of 20 Program Policy Analysis and Government Accountability shall 21 collect, review, and conduct an assessment of all existing 22 statewide articulation agreements and all existing 23 articulation agreements between school district career centers 24 or charter technical career centers and community colleges by 25 September 30, 2006. 26 (2) The Office of Program Policy Analysis and 27 Government Accountability shall use the information compiled 28 pursuant to subsection (1) to evaluate the effectiveness of 29 local and statewide interinstitutional articulation agreements 30 and to identify other postsecondary technical or career 31 programs within a school district career center or charter 9 8:04 AM 03/20/06 s2326d-ed20-c7t
