| 5 | enforcement, correctional, and correctional probation |
| 6 | officers for purposes of workers' compensation and |
| 7 | authorizing establishment of tobacco-use standards; |
| 8 | providing an effective date. |

| 10 | Be It Enacted by the Legislature of the State of Florida: |
| 11 |
|
| 12 | Section 1. Subsections (5) and (6) are added to section |
| 13 | 943.135, Florida Statutes, to read: |
| 14 | 943.135 Requirements for continued employment.-- |
| 15 | (5) An employing agency as defined in s. 943.10 may |
| 16 | require a law enforcement officer, correctional officer, or |
| 17 | correctional probation officer as defined in s. 943.10 who are |
| 18 | employed full time to successfully pass a physical examination |
| 19 | in order to be eligible for the presumption set forth in s. |
| 20 | 112.18. The employing agency shall have the physical examination |
| 21 | performed prior to or immediately upon employment of the |
| 22 | officer. This provision shall not affect the applicability of |
| 23 | the presumption set forth in s. 112.18 for law enforcement |
| 24 | officers, correctional officers, or correctional probation |
| 25 | officers who are currently employed by an employing agency. |
| 26 | (6) An employing agency as defined in s. 943.10 may set |
| 27 | tobacco-use standards for law enforcement officers, correctional |
| 28 | officers, and correctional probation officers as defined in s. |
| 29 | 943.10 who are employed full time. |
| 30 | Section 2. This act shall take effect October 1, 2006. |
