A bill to be entitled
2An act relating to continued employment requirements for
3law enforcement personnel; amending s. 943.135, F.S.;
4revising the presumption of disability for certain law
5enforcement, correctional, and correctional probation
6officers for purposes of workers' compensation and
7authorizing establishment of tobacco-use standards;
8providing an effective date.

10Be It Enacted by the Legislature of the State of Florida:

12     Section 1.  Subsections (5) and (6) are added to section
13943.135, Florida Statutes, to read:
14     943.135  Requirements for continued employment.--
15     (5)  An employing agency as defined in s. 943.10 may
16require a law enforcement officer, correctional officer, or
17correctional probation officer as defined in s. 943.10 who are
18employed full time to successfully pass a physical examination
19in order to be eligible for the presumption set forth in s.
20112.18. The employing agency shall have the physical examination
21performed prior to or immediately upon employment of the
22officer. This provision shall not affect the applicability of
23the presumption set forth in s. 112.18 for law enforcement
24officers, correctional officers, or correctional probation
25officers who are currently employed by an employing agency.
26     (6)  An employing agency as defined in s. 943.10 may set
27tobacco-use standards for law enforcement officers, correctional
28officers, and correctional probation officers as defined in s.
29943.10 who are employed full time.
30     Section 2.  This act shall take effect October 1, 2006.
