11  The Committee on Agriculture (Bullard) recommended the
12  following amendment:
13  
14         Senate Amendment (with title amendment) 
15         Delete everything after the enacting clause
16  
17  and insert:  
18         Section 1.  Paragraph (c) of subsection (3) and
19  paragraph (a) of subsection (4) of section 193.461, Florida
20  Statutes, are amended to read:
21         193.461  Agricultural lands; classification and
22  assessment; mandated eradication or quarantine program.--
23         (3)
24         (c)  The construction or maintenance of a dwelling on
25  part of the lands used for agricultural purposes shall not in
26  itself preclude an agricultural classification.
27         (4)(a)  The property appraiser shall reclassify the
28  following lands shall not be entitled to the agricultural
29  classification if any one of the following criteria is present
30  as nonagricultural:
31         1.  Land is diverted from an agricultural to a

 1  nonagricultural use;.
 2         2.  Land no longer is being used utilized for
 3  agricultural purposes; or.
 4         3.  Land that has been zoned to a nonagricultural use
 5  at the request of the owner subsequent to the enactment of
 6  this law.
 7         Section 2.  This act shall take effect July 1, 2006.

11  And the title is amended as follows:
12         Delete everything before the enacting clause

14  and insert:  
15                      A bill to be entitled
16         An act relating to the classification of
17         property; amending s. 193.461, F.S.; revising
18         provisions governing the classification of land
19         as agricultural for the purpose of tax
20         assessment; providing that construction of a
21         dwelling on part of lands used for agricultural
22         purposes does not in itself preclude
23         agricultural classification; revising criteria
24         under which agricultural classification of land
25         is prohibited; providing an effective date.
