6An act relating to the Florida KidCare program; amending
7s. 409.814, F.S.; providing for certain children who are
8ineligible to participate in the Florida KidCare program
9to be eligible for the Medikids program or the Florida
10Healthy Kids program; requiring that the Agency for Health
11Care Administration begin enrollment under the revised
12program criteria by a specified date; providing an
13effective date.

15Be It Enacted by the Legislature of the State of Florida:
16
17     Section 1.  Subsection (5) of section 409.814, Florida
18Statutes, is amended to read:
19     409.814  Eligibility.--A child who has not reached 19 years
20of age whose family income is equal to or below 200 percent of
21the federal poverty level is eligible for the Florida KidCare
22program as provided in this section. For enrollment in the
23Children's Medical Services Network, a complete application
24includes the medical or behavioral health screening. If,
25subsequently, an individual is determined to be ineligible for
26coverage, he or she must immediately be disenrolled from the
27respective Florida KidCare program component.
28     (5)  A child whose family income is above 200 percent of
29the federal poverty level or a child who is excluded under the
30provisions of subsection (4) may participate in the Medikids
31program as provided in s. 409.8132 or, if the child is
32ineligible for Medikids by reason of age, in the Florida Healthy
33Kids program Florida KidCare program, excluding the Medicaid
34program, but is subject to the following provisions:
35     (a)  The family is not eligible for premium assistance
36payments and must pay the full cost of the premium, including
37any administrative costs.
38     (b)  The agency is authorized to place limits on enrollment
39in Medikids by these children in order to avoid adverse
40selection. The number of children participating in Medikids
41whose family income exceeds 200 percent of the federal poverty
42level must not exceed 10 percent of total enrollees in the
43Medikids program.
44     (c)  The board of directors of the Florida Healthy Kids
45Corporation is authorized to place limits on enrollment of these
46children in order to avoid adverse selection. In addition, the
47board is authorized to offer a reduced benefit package to these
48children in order to limit program costs for such families. The
49number of children participating in the Florida Healthy Kids
50program whose family income exceeds 200 percent of the federal
51poverty level must not exceed 10 percent of total enrollees in
52the Florida Healthy Kids program.
53     (d)  Children described in this subsection are not counted
54in the annual enrollment ceiling for the Florida KidCare
55program.
56     Section 2.  The Agency for Health Care Administration shall
57begin enrollment under s. 409.814(5), Florida Statutes, as
58amended by this act, by July 1, 2006.
59     Section 3.  This act shall take effect July 1, 2006.
