A bill to be entitled
2An act relating to the Florida KidCare program; amending
3s. 409.814, F.S.; providing for certain children who are
4ineligible to participate in the Florida KidCare program
5to be eligible for the Medikids program or the Florida
6Healthy Kids program; requiring that the Agency for Health
7Care Administration begin enrollment under the revised
8program criteria by a specified date; providing an
9effective date.

11Be It Enacted by the Legislature of the State of Florida:

13     Section 1.  Subsection (5) of section 409.814, Florida
14Statutes, is amended to read:
15     409.814  Eligibility.--A child who has not reached 19 years
16of age whose family income is equal to or below 200 percent of
17the federal poverty level is eligible for the Florida KidCare
18program as provided in this section. For enrollment in the
19Children's Medical Services Network, a complete application
20includes the medical or behavioral health screening. If,
21subsequently, an individual is determined to be ineligible for
22coverage, he or she must immediately be disenrolled from the
23respective Florida KidCare program component.
24     (5)  A child whose family income is above 200 percent of
25the federal poverty level or a child who is excluded under the
26provisions of subsection (4) may participate in the Medikids
27program as provided in s. 409.8132 or, if the child is
28ineligible for Medikids by reason of age, in the Florida Healthy
29Kids program Florida KidCare program, excluding the Medicaid
30program, but is subject to the following provisions:
31     (a)  The family is not eligible for premium assistance
32payments and must pay the full cost of the premium, including
33any administrative costs.
34     (b)  The agency is authorized to place limits on enrollment
35in Medikids by these children in order to avoid adverse
36selection. The number of children participating in Medikids
37whose family income exceeds 200 percent of the federal poverty
38level must not exceed 10 percent of total enrollees in the
39Medikids program.
40     (c)  The board of directors of the Florida Healthy Kids
41Corporation is authorized to place limits on enrollment of these
42children in order to avoid adverse selection. In addition, the
43board is authorized to offer a reduced benefit package to these
44children in order to limit program costs for such families. The
45number of children participating in the Florida Healthy Kids
46program whose family income exceeds 200 percent of the federal
47poverty level must not exceed 10 percent of total enrollees in
48the Florida Healthy Kids program.
49     (d)  Children described in this subsection are not counted
50in the annual enrollment ceiling for the Florida KidCare
51program.
52     Section 2.  The Agency for Health Care Administration shall
53begin enrollment under s. 409.814(5), Florida Statutes, as
54amended by this act, by July 1, 2006.
55     Section 3.  This act shall take effect July 1, 2006.
