11 The Committee on Health Care (Jones) recommended the following
12 amendment:

17 and insert:
18 Section 1. Section 514.072, Florida Statutes, is
19 created to read:
20 514.072 Certification of swimming instructors for
21 people who have developmental disabilities required.--
22 (1) Any person working at a swimming pool who holds
23 himself or herself out as a swimming instructor specializing
24 in training people who have developmental disabilities, as
25 defined in s. 393.063(10), must be certified by the Dan Marino
26 Foundation, Inc., in addition to being certified under s.
27 514.071. The Dan Marino Foundation, Inc., must develop
28 certification requirements and a training curriculum for
29 swimming instructors for people who have developmental
30 disabilities and must submit the certification requirements to
31 the Department of Health for review by January 1, 2007. A

1 person certified under s. 514.071 before July 1, 2007, must
2 meet the additional certification requirements of this section
3 before January 1, 2008. A person certified under s. 514.071 on
4 or after July 1, 2007, must meet the additional certification
5 requirements of this section within 6 months after receiving
6 certification under s. 514.071.
7 (2) In addition to any other remedies available to the
8 department, the department may sue to enjoin the operation of
9 any public swimming pool that uses any swimming instructor in
10 violation of subsection (1).
11 Section 2. The sum of $535,000, of which $185,000 is
12 recurring, is appropriated from the General Revenue Fund to
13 the Department of Health for distribution to the Dan Marino
14 Foundation, Inc., for the 2006-2007 fiscal year for the
15 purpose of implementing this act.
