1 A bill to be entitled
2 An act relating to certification of swimming
3 instructors; creating s. 514.072, F.S.;
4 requiring additional certification of swimming
5 instructors for people who have developmental
6 disabilities; providing a remedy for
7 certification violations; providing an
8 appropriation; providing an effective date.

10 Be It Enacted by the Legislature of the State of Florida:

12 Section 1. Section 514.072, Florida Statutes, is
13 created to read:
14 514.072 Certification of swimming instructors for
15 people who have developmental disabilities required.--
16 (1) Any person working at a public swimming pool as a
17 swimming instructor for people who have developmental
18 disabilities, as defined in s. 393.063(10), must be certified
19 by the Dan Marino Foundation, Inc., in addition to being
20 certified under s. 514.071. A person certified under s.
21 514.071 before July 1, 2006, must meet the additional
22 certification requirements of this section by January 1, 2007.
23 A person certified under s. 514.071 on or after July 1, 2006,
24 must meet the additional certification requirements of this
25 section within 6 months after receiving certification under s.
26 514.071.
27 (2) In addition to any other remedies available to the
28 department, the department may sue to enjoin the operation of
29 any public swimming pool that uses any swimming instructor in
30 violation of subsection (1).

1 Section 2. The sum of $535,000 is appropriated from
2 the General Revenue Fund to the Department of Health for the
3 2006-2007 fiscal year for the purpose of implementing this
4 act, to be distributed as follows: $185,000 in recurring
5 revenue to the Dan Marino Foundation, Inc., for swimming
6 certification; $150,000 in nonrecurring revenue to Broward
7 County Parks and Recreation for the SWIM Central Special Needs
8 Certification, and $200,000 in nonrecurring revenue to the
9 Weston YMCA for special needs modifications and enhancement
10 for the developmentally disabled.
11 Section 3. This act shall take effect July 1, 2006.
