2An act relating to hearing aid specialists; amending s.
3456.062, F.S.; eliminating the application of certain
4advertising requirements to health care practitioners
5licensed under pt. II of ch. 484, F.S., relating to the
6regulation of hearing aid specialists; providing an
7effective date.

9Be It Enacted by the Legislature of the State of Florida:

11     Section 1.  Section 456.062, Florida Statutes, is amended
12to read:
13     456.062  Advertisement by a health care practitioner of
14free or discounted services; required statement.--In any
15advertisement for a free, discounted fee, or reduced fee
16service, examination, or treatment by a health care practitioner
17licensed under chapter 458, chapter 459, chapter 460, chapter
18461, chapter 462, chapter 463, chapter 464, chapter 465, chapter
19466, chapter 467, chapter 478, chapter 483, part I of chapter
20484, chapter 486, chapter 490, or chapter 491, the following
21statement shall appear in capital letters clearly
22distinguishable from the rest of the text: THE PATIENT AND ANY
23OTHER PERSON RESPONSIBLE FOR PAYMENT HAS A RIGHT TO REFUSE TO
24PAY, CANCEL PAYMENT, OR BE REIMBURSED FOR PAYMENT FOR ANY OTHER
25SERVICE, EXAMINATION, OR TREATMENT THAT IS PERFORMED AS A RESULT
26OF AND WITHIN 72 HOURS OF RESPONDING TO THE ADVERTISEMENT FOR
27THE FREE, DISCOUNTED FEE, OR REDUCED FEE SERVICE, EXAMINATION,
28OR TREATMENT. However, the required statement shall not be
29necessary as an accompaniment to an advertisement of a licensed
30health care practitioner defined by this section if the
31advertisement appears in a classified directory the primary
32purpose of which is to provide products and services at free,
33reduced, or discounted prices to consumers and in which the
34statement prominently appears in at least one place.
35     Section 2.  This act shall take effect July 1, 2006.
