18 Section 1. Section 403.7187, Florida Statutes, is
19 created to read:

21 403.7187 Mercury switch removal, collection, and
22 recovery.
23 (1) This section may be cited as the "Florida Vehicle
24 Mercury Switch Recovery Act." The purpose of this section is
25 to reduce mercury in the environment by removing mercury
26 switches from end-of-life vehicles and creating a program to
27 collect and recover mercury switches that are removed from
28 end-of-life vehicles in this state.
29 (2) As used in this section, the term:
30 (a) "Department" means the Department of Environmental
31 Protection.

1 (b) "End-of-life vehicle" means a vehicle that is
2 sold, given, or otherwise conveyed to a vehicle recycler or
3 scrap recycling facility for recycling.
4 (c) "End-of-Life Vehicle Solutions Corporation" means
5 the corporate entity created by the manufacturers to contract
6 with a waste management company to advance the corporation's
7 mission of vehicle recyclability through education, outreach,
8 and proper management of mercury switches contained in
9 end-of-life vehicles.
10 (d) "End-of-Life Vehicle Solutions Program" means the
11 plan and procedure by which the End-of-Life Vehicle Solutions
12 Corporation advances its mission of vehicle recyclability
13 through education, outreach, and proper management of mercury
14 switches contained in end-of-life vehicles.
15 (e) "Manufacturer" means, but is not limited to, BMW
16 of North America, LLC; Daimler Chrysler Corporation; Ford
17 Motor Company; General Motors Corporation; Mitsubishi Motors
18 North America, Inc.; Nissan North America, Inc.; Subaru of
19 America, Inc.; and Volkswagen of America, Inc.
20 (f) "Mercury switch" means each mercury-containing
21 capsule, commonly known as a "bullet," which is part of a
22 convenience light switch assembly on a vehicle.
23 (g) "National Vehicle Mercury Switch Recovery Program"
24 means the voluntary and collaborative plan and procedure by
25 which the manufacturers, steelmakers, scrap recycling
26 facilities, vehicle recyclers, the United States Environmental
27 Protection Agency, and others, commit to reduce mercury in the
28 environment through the systematic, nationwide use of best
29 practices for vehicle recyclability through education,
30 outreach, and proper management of mercury switches contained
31 in end-of-life vehicles.

1 (h) "Person" means an individual, corporation,
2 company, firm, partnership, association, trust, joint-stock
3 company or trust, venture, or municipal, state, or federal
4 government or agency, or any other legal entity, however
5 organized.
6 (i) "Scrap recycling facility" means a person who is
7 engaged in a business that uses machinery and equipment to
8 process and manufacture scrap metal into prepared grades and
9 that principally produces scrap iron, scrap steel, or
10 nonferrous metallic scrap for sale for remelting purposes.
11 (j) "Vehicle" means a passenger automobile or
12 passenger car, station wagon, truck, van, or sport utility
13 vehicle having a gross vehicle weight rating of less than
14 12,000 pounds.
15 (k) "Vehicle recycler" means a person engaged in the
16 business of acquiring, dismantling, or destroying six or more
17 end-of-life vehicles in a calendar year.
18 (3) On or before September 1, 2006, the End-of-Life
19 Vehicle Solutions Corporation shall, in conjunction with the
20 Department, identify the scrap recycling facilities and
21 vehicle recyclers in Florida and invite their voluntary
22 participation in the End-of-Life Vehicle Solutions Program. As
23 Program participants themselves, manufacturers will provide
24 scrap recycling facilities and vehicle recyclers with
25 educational materials about the End-of-Life Vehicle Solutions
26 Program, guidance on which vehicles contain mercury switches,
27 and instructions on how to remove mercury switches.
28 Manufacturers will also provide collection containers for
29 collecting and storing vehicle mercury switches, arrange and
30 pay for the transportation of the switches to recycling or
31 disposal sites approved by the United States Environmental

1 Protection Agency, arrange and pay for the recycling and
2 disposal of the mercury contained in the switches, and track
3 participation in the End-of-Life Vehicle Solutions Program and
4 the mercury switch collection process.
5 Section 2. This Act shall stand repealed upon the
6 earlier of the two following dates:
7 (1) the date on which the National Vehicle Mercury
8 Switch Recovery Program takes effect; or (2) July 1, 2016.
9 Section 3. This Act shall take effect on July 1, 2006.
