11  The Committee on Transportation (Sebesta) recommended the
12  following amendment:
13  
14         Senate Amendment 
15         On page 3, line 23, through
16            page 5, line 25 delete those lines
17  
18  and insert:  capsule, commonly known as a "bullet," and the
19  convenience light switch assembly on a vehicle of which it is
20  part.
21         (f)  "Person" means an individual, corporation,
22  company, firm, partnership, association, trust, joint-stock
23  company or trust, venture, or municipal, state, or federal
24  government or agency, or any other legal entity, however
25  organized.
26         (g)  "Scrap recycling facility" means a person who is
27  engaged in a business that uses machinery and equipment to
28  process and manufacture scrap metal into prepared grades and
29  that principally produces scrap iron, scrap steel, or
30  nonferrous metallic scrap for sale for remelting purposes.
31         (h)  "Vehicle" means a passenger automobile or

Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2446 Barcode 544906 1 passenger car, station wagon, truck, van, or sport utility 2 vehicle having a gross vehicle weight rating of less than 3 12,000 pounds. 4 (i) "Vehicle recycler" means a person engaged in the 5 business of acquiring, dismantling, or destroying six or more 6 end-of-life vehicles in a calendar year. 7 (3) By October 1, 2006, each manufacturer shall, 8 individually or as part of a group of manufacturers, submit a 9 mercury minimization plan to the department for review and 10 approval. The plan must be developed in consultation with the 11 department and must, at minimum, include: 12 (a) For each vehicle that contains one or more mercury 13 switches and that was produced, is in production, or is 14 planned for production, a description of: 15 1. The make, model, and year of the vehicle. 16 2. Each mercury switch in the vehicle, including, but 17 not limited to, the location of the switch. If a manufacturer 18 is uncertain whether a convenience light switch assembly in a 19 vehicle that such manufacturer is producing, or plans to 20 produce, contains a mercury switch, such switch is presumed to 21 be a mercury switch. 22 3. A system to mark the vehicle to indicate the 23 presence or absence of each mercury switch to a vehicle 24 recycler or scrap recycling facility that may process the 25 vehicle for shredding or crushing. 26 (b) A description of the safe and environmentally 27 sound methods for removing mercury switches from end-of-life 28 vehicles. 29 (c) Educational materials to assist a vehicle recycler 30 or scrap recycling facility in undertaking a safe and 31 environmentally sound method for the removal of mercury 2 11:34 AM 04/17/06 s2446b-tr16-e0a
Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2446 Barcode 544906 1 switches from end-of-life vehicles, including, but not limited 2 to, information concerning the hazards and proper handling of 3 mercury. 4 (d) A recommended method for storing and shipping 5 mercury switches that are removed from end-of-life vehicles, 6 including, but not limited to, a method of packaging and 7 shipping the switches to a facility that is authorized to 8 recycle, store, or dispose of them in an environmentally 9 appropriate manner. 10 (e) A recommended method for storing the mercury 11 switches that are removed from end-of-life vehicles if a 12 technology to manage the switches in an environmentally 13 appropriate manner is unavailable. 14 (f) Provisions to ensure that existing infrastructure 15 to recycle end-of-life vehicles is used to the extent 16 practicable.
