4 | On page 28, between lines 29 and 30, insert: |
5 | (5) The commission shall adopt a rule establishing |
6 | adequate due process procedures to be accorded to any party, as |
7 | defined in s. 120.52, whose substantial interests are affected |
8 | by any action of the commission in the performance of its |
9 | constitutional duties and responsibilities. The adequate due |
10 | process rule shall be published in the Florida Administrative |
11 | Code. |
12 | (6) All existing and proposed rules of the commission |
13 | shall be subject to the provisions of s. 120.56. |
14 | Section 9. The Fish and Wildlife Conservation Commission's |
15 | enforcement of all penalty provisions under this act shall be |
16 | contingent upon the final adoption of the adequate due process |
17 | rule as required under s. 370.025(5), Florida Statutes. |
18 | Section 10. All appropriations to the Fish and Wildlife |
19 | Conservation Commission for the 2006-2007 fiscal year shall be |
20 | contingent upon the final adoption of the adequate due process |
