11  Senator Argenziano moved the following amendment:

13         Senate Amendment (with title amendment) 
14         On page 3, lines 1 through 6, delete those lines
15  
16  and insert:  
17         Section 1.  Paragraph (f) of subsection (5), paragraph
18  (a) of subsection (14), and paragraph (b) of subsection (17)
19  of section 287.057, Florida Statutes, are amended, and
20  subsection (26) is added to that section, to read:
21         287.057  Procurement of commodities or contractual
22  services.--
23         (5)  When the purchase price of commodities or
24  contractual services exceeds the threshold amount provided in
25  s. 287.017 for CATEGORY TWO, no purchase of commodities or
26  contractual services may be made without receiving competitive
27  sealed bids, competitive sealed proposals, or competitive
28  sealed replies unless:
29         (f)  The following contractual services and commodities
30  are not subject to the competitive-solicitation requirements
31  of this section:

Legal services, including attorney, paralegal, 6 expert witness, appraisal, or mediator services. 7 6. Health services involving examination, diagnosis, 8 treatment, prevention, medical consultation, or 9 administration. This subparagraph does not apply to the 10 Department of Correction. 11 7. Services provided to persons with mental or 12 physical disabilities by not-for-profit corporations which 13 have obtained exemptions under the provisions of s. 501(c)(3) 14 of the United States Internal Revenue Code or when such 15 services are governed by the provisions of Office of 16 Management and Budget Circular A-122. However, in acquiring 17 such services, the agency shall consider the ability of the 18 vendor, past performance, willingness to meet time 19 requirements, and price. 20 8. Medicaid services delivered to an eligible Medicaid 21 recipient by a health care provider who has not previously 22 applied for and received a Medicaid provider number from the 23 Agency for Health Care Administration. However, this exception 24 shall be valid for a period not to exceed 90 days after the 25 date of delivery to the Medicaid recipient and shall not be 26 renewed by the agency. 27 9. Family placement services. 28 10. Prevention services related to mental health, 29 including drug abuse prevention programs, child abuse 30 prevention programs, and shelters for runaways, operated by 31 not-for-profit corporations. Training and education services provided to 5 injured employees pursuant to s. 440.491(6). 6 12. Contracts entered into pursuant to s. 337.11. 7 13. Services or commodities provided by governmental 8 agencies. 9 14. Voter education activities of the Department of 10 State or the supervisors of elections funded by Specific 11 Appropriation 2871H of the 2004-2005 General Appropriations 12 Act, either individually or in the aggregate or with their 13 respective professional associations.
