| 7 | to read: |
| 8 | 287.0577 Productivity Commission.-- |
| 9 | (1) PRODUCTIVITY COMMISSION.--There is created within the |
| 10 | Executive Office of the Governor a Productivity Commission |
| 11 | composed of the Governor and Cabinet. The Governor is chair of |
| 12 | the commission. The Governor or the Chief Financial Officer may |
| 13 | call a meeting of the commission promptly each time the need |
| 14 | therefore arises. Unless otherwise provided herein, affirmative |
| 15 | action by the commission shall require the approval of the |
| 16 | Governor and at least two other members of the commission. The |
| 17 | commission is subject to all relevant requirements contained in |
| 18 | s. 20.052. |
| 19 | (2) FLEXIBLE FLORIDA GOVERNMENT AWARD.--The Legislature |
| 20 | finds that incentive awards are an effective tool for |
| 21 | encouraging creative and innovative solutions within government |
| 22 | agencies. In order to provide incentives to executive agency |
| 23 | personnel to create, implement, or participate in flexible |
| 24 | methods of delivering services to the citizens of the state, the |
| 25 | Legislature hereby creates the Flexible Florida Government |
| 26 | Award. |
| 27 | (3) DEFINITIONS.--For purposes of this section, the |
| 28 | following definitions apply: |
| 29 | (a) "Award" means the Flexible Florida Government Award |
| 30 | created in subsection (2). |
| 31 | (b) "Commission" means the Productivity Commission created |
| 32 | in subsection (1). |
| 33 | (c) "Eligible awardee" means any department, division, |
| 34 | bureau, section, office, or other structural unit of the |
| 35 | executive branch, or any personnel providing services for such a |
| 36 | unit. |
| 37 | (d) "Eligible project" means any program or activity |
| 38 | subject to the review process contained in s. 287.0574. |
| 39 | (4) ORGANIZATION; DUTIES.--The commission shall meet once |
| 40 | annually to review all eligible projects and eligible awardees |
| 41 | involved in eligible projects. The commission may issue any |
| 42 | number of awards, however, the cumulative total of all awards |
| 43 | shall not exceed $100,000. Awards shall be issued in the |
| 44 | following manner: |
| 45 | (a) Any member of the commission may submit to the chair a |
| 46 | request identifying a potential award. The request must contain: |
| 47 | 1. A description of the activity or service delivered by |
| 48 | the project. |
| 49 | 2.a. If the potential award is based on agency cost- |
| 50 | avoidance, an explanation of savings generated by the project |
| 51 | since its inception; |
| 52 | b. If the potential award is based on agency innovation, |
| 53 | the additional services provided at the same cost; or |
| 54 | c. If the potential award is based on a transformation of |
| 55 | services provided, the fundamental change in the services |
| 56 | provided. |
| 57 | 3. The eligible awardees, including a list of every |
| 58 | individual in the unit intended to receive the award and the |
| 59 | amount granted to each individual. |
| 60 | (b) The commission shall review and vote on all member |
| 61 | requests. Upon the successful vote of at least three members of |
| 62 | the commission, the request shall be granted and an award issued |
| 63 | to the eligible awardees identified in the request. |
