1 A bill to be entitled
2 An act relating to public educational
3 facilities; amending s. 1013.12, F.S.;
4 clarifying that the architectural design and
5 plans for constructing new educational plants
6 and facilities or for modifying existing plants
7 and facilities are not subject to the
8 jurisdiction of local fire officials;
9 authorizing a district school board to request
10 that a local fire official resolve an ambiguity
11 in the uniform firesafety standards with
12 respect to new or modified construction;
13 requiring that such assistance be provided at
14 no cost; providing an effective date.

16 Be It Enacted by the Legislature of the State of Florida:
17
18 Section 1. Present subsection (7) of section 1013.12,
19 Florida Statutes, is redesignated as subsection (8), and a new
20 subsection (7) is added to that section, to read:
21 1013.12 Casualty, safety, sanitation, and firesafety
22 standards and inspection of property.--The State Board of
23 Education shall adopt and administer rules prescribing
24 standards for the safety and health of occupants of
25 educational and ancillary plants as a part of State
26 Requirements for Educational Facilities or the Florida
27 Building Code for educational facilities construction as
28 provided in s. 1013.37, except that the State Fire Marshal in
29 consultation with the Department of Education shall adopt
30 uniform firesafety standards for educational and ancillary
31 plants and educational facilities, as provided in s.

1 633.022(1)(b), and a firesafety evaluation system to be used
2 as an alternate firesafety inspection standard for existing
3 educational and ancillary plants and educational facilities.
4 The uniform firesafety standards and the alternate firesafety
5 evaluation system shall be administered and enforced by local
6 fire officials. These standards must be used by all public
7 agencies when inspecting public educational and ancillary
8 plants, and the firesafety standards must be used by local
9 fire officials when performing firesafety inspections of
10 public educational and ancillary plants and educational
11 facilities. In accordance with such standards, each board
12 shall prescribe policies and procedures establishing a
13 comprehensive program of safety and sanitation for the
14 protection of occupants of public educational and ancillary
15 plants. Such policies must contain procedures for periodic
16 inspections as prescribed herein and for withdrawal of any
17 educational and ancillary plant, or portion thereof, from use
18 until unsafe or unsanitary conditions are corrected or
19 removed.
20 (7) FIRESAFETY STANDARDS FOR NEW CONSTRUCTION.--The
21 architectural design and plans for the construction of new
22 public educational and ancillary plants and educational
23 facilities or for the modification of existing plants and
24 facilities are not subject to the jurisdiction of local fire
25 officials. However, a local fire official may be requested to
26 resolve an ambiguity in the uniform firesafety standards with
27 respect to new construction or the modification of an existing
28 facility. The local fire official shall provide such
29 assistance at no cost to the district school board.
30 Section 2. This act shall take effect July 1, 2006.
