  1                      A bill to be entitled

  2         An act relating to the Florida High School

  3         Athletic Association; amending s. 1006.20,

  4         F.S.; requiring that the bylaws of the

  5         association allow a student who transfers to or

  6         from a private school to be eligible to engage

  7         in high school athletic competition at the new

  8         school in the year of the transfer; providing

  9         retroactivity; providing an effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Paragraph (a) of subsection (2) of section

14  1006.20, Florida Statutes, is amended to read:

15         1006.20  Athletics in public K-12 schools.--

16         (2)  ADOPTION OF BYLAWS.--

17         (a)  The organization shall adopt bylaws that, unless

18  specifically provided by statute, establish eligibility

19  requirements for all students who participate in high school

20  athletic competition in its member schools. The bylaws

21  governing residence and transfer shall allow the student to be

22  eligible in the school in which he or she first enrolls each

23  school year, or makes himself or herself a candidate for an

24  athletic team by engaging in a practice prior to enrolling in

25  any member school; however, a student who transfers from a

26  nonpublic member school to a public school or to another

27  nonpublic member school or transfers from a public school to a

28  nonpublic member school must be allowed to be eligible in the

29  school to which he or she transfers during the academic year

30  in which the transfer occurs. The student shall be eligible in

31  that school so long as he or she remains enrolled in that

 1  school. Subsequent eligibility shall be determined and

 2  enforced through the organization's bylaws.

 3         Section 2.  This act shall take effect upon becoming a

 4  law and applies retroactively to January 1, 2006.

 8    Requires that the bylaws of the Florida High School
      Athletic Association allow a student who transfers to or
 9    from a private school to be eligible to engage in high
      school athletic competition at the new school in the year
