18 Section 1. Section 381.853, Florida Statutes, is
19 created to read:
20 381.853 Florida Center for Brain Tumor Research.--
21 (1) The Legislature finds that each year an estimated
22 190,000 citizens of the United States are diagnosed with
23 cancerous and noncancerous brain tumors and that biomedical
24 research is the key to finding cures for these tumors. The
25 Legislature further finds that, although brain tumor research
26 is being conducted throughout the state, there is a lack of
27 coordinated efforts among researchers and health care
28 providers. Therefore, the Legislature finds that there is a
29 significant need for a coordinated effort to achieve the goal
30 of curing brain tumors. The Legislature further finds that the
31 biomedical technology sector meets the criteria of a

1 high-impact sector, pursuant to s. 288.108(6), having a high
2 importance to the state's economy with a significant potential
3 for growth and contribution to our universities and quality of
4 life.
5 (2) It is the intent of the Legislature to establish a
6 coordinated effort among the state's public and private
7 universities and hospitals and the biomedical industry to
8 discover brain tumor cures and develop brain tumor treatment
9 modalities. Moreover, it is the intent of the Legislature to
10 expand the state's economy by attracting biomedical
11 researchers and research companies to the state.
12 (3) The Evelyn F. and William L. McKnight Brain
13 Institute of the University of Florida shall work with other
14 institutions and organizations to develop and maintain a brain
15 tumor registry that is an automated, electronic, and
16 centralized database of individuals with brain tumors. The
17 individual, or the parent or guardian of the individual if the
18 individual is a minor, may refuse to participate in the brain
19 tumor registry by signing a form obtained from the department
20 or from the health care practitioner or entity that provides
21 brain tumor care or treatment which indicates that the
22 individual does not wish to be included in the registry. The
23 decision to not participate in the registry must be noted in
24 the registry.
25 (4) The Florida Center for Brain Tumor Research is
26 established within the Evelyn F. and William L. McKnight Brain
27 Institute of the University of Florida.
28 (a) The purpose of the center is to foster
29 collaboration with brain cancer research organizations and
30 other institutions, provide a central repository for brain
31 tumor biopsies from individuals throughout the state, improve

1 and monitor brain tumor biomedical research programs within
2 the state, facilitate funding opportunities, and foster
3 improved technology transfer of brain tumor research findings
4 into clinical trials and widespread public use.
5 (b) The goal of the center is to find cures for brain
6 tumors.
7 (c) Funds specifically appropriated by the Legislature
8 for peer-reviewed brain tumor research shall be awarded using
9 a competitive grant process developed by the center.
10 (d) The center shall hold an annual brain tumor
11 biomedical technology summit in the state to which scientists
12 conducting basic peer-reviewed scientific research from the
13 state's public and private universities, teaching hospitals,
14 and for-profit and nonprofit institutions are invited to share
15 biomedical research findings in order to expedite the
16 discovery of cures. Summit attendees shall cover the costs of
17 such attendance or obtain sponsorship for such attendance.
18 (e) The center shall encourage clinical trials in the
19 state on research that holds the promise of curing brain
20 tumors. The center shall facilitate the formation of
21 partnerships between researchers, physicians, clinicians, and
22 hospitals for the purpose of sharing new techniques and new
23 research findings and coordinating the voluntary donation of
24 brain tumor biopsies.
25 (f) The center shall submit an annual report to the
26 Governor, the President of the Senate, the Speaker of the
27 House of Representatives, and the Secretary of Health no later
28 than January 15 that contains recommendations for legislative
29 changes necessary to foster a positive climate for the pursuit
30 of brain tumor research and the development of treatment
31 modalities in the state.

1 (g) The center shall be funded through private, state,
2 and federal sources.
3 (5) There is established within the center a
4 scientific advisory council that includes biomedical
5 researchers, physicians, clinicians, and representatives from
6 public and private universities and hospitals. The council
7 shall meet at least annually.
8 (a) The council shall consist of:
9 1. Two members from the Florida Center for Brain Tumor
10 Research within the Evelyn F. and William L. McKnight Brain
11 Institute of the University of Florida appointed by the
12 Governor.
13 2. Two members from the Scripps Research Institute,
14 one of whom must have expertise in basic brain tumor research,
15 appointed by the Speaker of the House of Representatives.
16 3. Two members from other public and private
17 universities and institutions directly involved in brain tumor
18 research appointed by the President of the Senate.
19 4. One member from the Mayo Clinic in Jacksonville who
20 is directly involved in the treatment of brain tumor patients
21 or who has expertise in basic brain tumor research appointed
22 by the Secretary of Health.
23 5. Two members from the Cleveland Clinic in Florida
24 who are directly involved in basic brain tumor research
25 appointed by the Governor.
26 6. One member from the H. Lee Moffitt Cancer Center
27 and Research Institute who is directly involved in the
28 treatment of brain tumor patients or who has expertise in
29 basic brain tumor research appointed by the Speaker of the
30 House of Representatives.
31 7. One member from the M.D. Anderson Cancer Center

1 Orlando who is directly involved in the treatment of brain
2 tumor patients or who has expertise in basic brain tumor
3 research appointed by the President of the Senate.
4 (b) Council members shall serve staggered 4-year
5 terms.
6 (c) Council members shall serve without compensation,
7 and each organization represented shall cover all expenses of
8 its representative.
9 Section 2. This act shall take effect July 1, 2006.
