  1                      A bill to be entitled

  2         An act relating to trust funds; creating s.

  3         1002.332, F.S.; creating the Florida Schools of

  4         Excellence Fund within the Department of

  5         Education; providing for sources of moneys and

  6         purposes of the fund; providing for the annual

  7         carryforward of funds; providing for future

  8         review and termination or re-creation of the

  9         fund; providing a contingent effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Section 1002.332, Florida Statutes, is

14  created to read:

15         1002.332  Florida Schools of Excellence Fund.--

16         (1)  The Florida Schools of Excellence Fund is created

17  within the Department of Education. Grants, donations, or

18  other private or public funds received by the department for

19  the purpose of operating the Florida Schools of Excellence

20  Office shall be deposited into the fund and used for the

21  purposes set forth in s. 1002.331.

22         (2)  Notwithstanding s. 216.301 and pursuant to s.

23  216.351, any balance in the fund at the end of a fiscal year

24  shall remain in the fund and be available for carrying out the

25  purposes of the trust fund.

26         (3)  Pursuant to s. 19(f)(2), Art. III of the State

27  Constitution, the fund shall, unless terminated sooner, be

28  terminated on July 1, 2010. Before its scheduled termination,

29  the trust fund shall be reviewed as provided in s. 215.3206(1)

30  and (2).

 1         Section 2.  This act shall take effect July 1, 2006, if

 2  Senate Bill ____, or similar legislation, is adopted in the

 3  same legislative session or an extension thereof and becomes

 4  law.
