17  and insert:  
18         Section 1.  Section 1003.453, Florida Statutes, is
19  created to read:
20         1003.453  School wellness and physical education
21  policies; nutrition guidelines.--
22         (1)  By September 1, 2006, each school district shall
23  submit to the Department of Education a copy of its school
24  wellness policy as required by the Child Nutrition and WIC
25  Reauthorization Act of 2004 and a copy of its physical
26  education policy required under s. 1003.455. Each school
27  district shall annually review its school wellness policy and
28  physical education policy and provide a procedure for public
29  input and revisions. In addition, each school district shall
30  send an updated copy of its wellness policy and physical
31  education policy to the department when a change or revision

Each school 6 district shall provide the most current versions of its school 7 wellness policy and physical education policy on the 8 district's website. 9 (3) By December 1, 2006, the department must provide 10 on its website links to resources that include information 11 regarding: 12 (a) Classroom instruction on the benefits of exercise 13 and healthful eating. 14 (b) Classroom instruction on the health hazards of 15 using tobacco and being exposed to tobacco smoke. 16 (c) The eight components of a coordinated school 17 health program, including health education, physical 18 education, health services, and nutrition services. 19 (d) The core measures for school health and wellness, 20 such as the School Health Index. 21 (e) Access for each student to the nutritional content 22 of foods and beverages and to healthful food choices in 23 accordance with the dietary guidelines of the United States 24 Department of Agriculture. 25 (f) Multiple examples of school wellness policies for 26 school districts. 27 (g) Examples of wellness classes that provide 28 nutrition education for teachers and school support staff, 29 including encouragement to provide classes that are taught by 30 a licensed nutrition professional from the school nutrition 31 department. 2 1:41 PM 04/17/06 s2602d-ed20-c3r
Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2602 Barcode 815254 1 (4) School districts are encouraged to provide basic 2 training in first aid, including cardiopulmonary 3 resuscitation, for all students, beginning in grade 6 and 4 every 2 years thereafter. Private and public partnerships for 5 providing training or necessary funding are encouraged. 6 Section 2. Section 1003.455, Florida Statutes, is 7 amended to read: 8 1003.455 Physical education; assessment.-- 9 (1) It is the responsibility of each district school 10 board to develop a physical education program that stresses 11 physical fitness and encourages healthful healthy, active 12 lifestyles and to encourage all students in prekindergarten 13 through grade 12 to participate in physical education. 14 Physical education shall consist of physical activities of at 15 least a moderate intensity level and for a duration sufficient 16 to provide a significant health benefit to students, subject 17 to the differing capabilities of students. All physical 18 education programs and curricula must be reviewed by a 19 certified physical education instructor. 20 (2) Each district school board shall, no later than 21 December 1, 2004, adopt a written physical education policy 22 that details the school district's physical education program 23 and expected program outcomes. Each district school board 24 shall provide a copy of its written policy to the Department 25 of Education by December 15, 2004. 26 (3) Each district school board is encouraged to 27 provide 150 minutes of physical education each week for 28 students in kindergarten through grade 5 and 225 minutes each 29 week for students in grades 6 through 8. Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2602 Barcode 815254 1 education program for kindergarten through grade 5 which 2 provides students with 30 minutes of physical education each 3 day, 3 days a week. 4 Section 3. Subsections (2) and (5) of section 5 381.0056, Florida Statutes, are amended to read: 6 381.0056 School health services program.-- 7 (2) The Legislature finds that health services 8 conducted as a part of the total school health program should 9 be carried out to appraise, protect, and promote the health of 10 students. School health services supplement, rather than 11 replace, parental responsibility and are designed to encourage 12 parents to devote attention to child health, to discover 13 health problems, and to encourage use of the services of their 14 physicians, dentists, and community health agencies. Each 15 school shall annually provide all parents and guardians with 16 information on ways that they can help their children to be 17 physically active and to eat healthful foods. 18 (5)(a) Each county health department shall develop, 19 jointly with the district school board and the local school 20 health advisory committee, a school health services plan; and 21 the plan must shall include, at a minimum, provisions for: 22 1.(a) Health appraisal; 23 2.(b) Records review; 24 3.(c) Nurse assessment; 25 4.(d) Nutrition assessment; 26 5.(e) A preventive dental program; 27 6.(f) Vision screening; 28 7.(g) Hearing screening; 29 8.(h) Scoliosis screening; 30 9.(i) Growth and development screening; 31 10.(j) Health counseling; 4 1:41 PM 04/17/06 s2602d-ed20-c3r
Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. SB 2602 Barcode 815254 1 11.(k) Referral and followup of suspected or confirmed 2 health problems by the local county health department; 3 12.(l) Meeting emergency health needs in each school; 4 13.(m) County health department personnel to assist 5 school personnel in health education curriculum development; 6 14.(n) Referral of students to appropriate health 7 treatment, in cooperation with the private health community 8 whenever possible; 9 15.(o) Consultation with a student's parent or 10 guardian regarding the need for health attention by the family 11 physician, dentist, or other specialist when definitive 12 diagnosis or treatment is indicated; 13 16.(p) Maintenance of records on incidents of health 14 problems, corrective measures taken, and such other 15 information as may be needed to plan and evaluate health 16 programs; except, however, that provisions in the plan for 17 maintenance of health records of individual students must be 18 in accordance with s. 1002.22; 19 17.(q) Health information which will be provided by 20 the school health nurses, when necessary, regarding the 21 placement of students in exceptional student programs and the 22 reevaluation at periodic intervals of students placed in such 23 programs; and 24 18.(r) Notification to the local nonpublic schools of 25 the school health services program and the opportunity for 26 representatives of the local nonpublic schools to participate 27 in the development of the cooperative health services plan. 28 (b) Each school health advisory committee must, at a 29 minimum, include members who represent the eight component 30 areas of the Coordinated School Health model as defined by the 31 Centers for Disease Control and Prevention.
