 6         process; and s. 1008.51, F.S., relating to the

 7         Council for Education Policy Research and

 8         Improvement; providing an effective date.

10  Be It Enacted by the Legislature of the State of Florida:

11  

12         Section 1.  Policy review of education assessment by

13  OPPAGA.--

14         (1)  The Office of Program Policy Analysis and

15  Government Accountability shall conduct a comprehensive policy

16  review of chapter 1008, Florida Statutes, relating to

17  assessment and accountability in education, grades

18  kindergarten through 20, and shall report its findings to the

19  Legislature by February 1, 2007.

20         (2)  The policy review required under subsection (1)

21  must include:

22         (a)  The impact of mandatory retention in grades 3 and

23  10 and an analysis of the level of education gains by those

24  students who have been retained.

25         (b)  The impact of mandatory retention on graduation

26  rates in this state.

27         (c)  The outcomes that disabled or learning-disabled

28  students who have individual education plans under the federal

29  Individuals with Disabilities Education Act or 504 plans have

30  attained on state standardized tests.

 1         (d)  Discrepancies and conflicts between the state

 2  measures of student gains and the federal measures of student

 3  gains under the No Child Left Behind Act of 2001.

 4         (e)  The impact on student instruction of preparation

 5  for the Florida Comprehensive Assessment Test (FCAT).

 6         (f)  How the students in this state compare nationally

 7  with respect to performance on nationally normed tests.

 8         (g)  The positive and negative effects, if any, of the

 9  Department of Education's current policy of administering the

10  FCAT during the beginning of the school year, as well as the

11  positive or negative effects, if any, which might be expected

12  if the test were administered in at least three other distinct

13  periods during the school year.

14         Section 2.  Chapter 1008, Florida Statutes, consisting

15  of ss. 1008.22, 1008.221, 1008.23, 1008.24, 1008.25, 1008.29,

16  1008.30, 1008.301, 1008. 31, 1008.32, 1008.33, 1008.34,

17  1008.345, 1008.35, 1008.36, 1008.37, 1008.38, 1008.385,

18  1008.386, 1008.39, 1008.40, 1008.405, 1008.41, 1008.42,

19  1008.43, 1008.45, 1008.46, and 1008.51, Florida Statutes, is

20  repealed effective August 1, 2007, unless reenacted and

21  revived by the Legislature before that date.

22         Section 3.  This act shall take effect upon becoming a

23  law.

26                          SENATE SUMMARY

27    Relates to assessment and accountability in education.
      Requires the Office of Program Policy Analysis and
28    Government Accountability to conduct a policy review of
      ch. 1008, F.S., and report to the Legislature by February
29    1, 2007. Provides requirements for matters to be
      reviewed. Provides for the repeal of ch. 1008, F.S.,
30    effective August 1, 2007, unless reviewed and reenacted
      by the Legislature before that date.
