1 A bill to be entitled
2 An act relating to medical care; creating ss.
3 458.3246 and 459.0127, F.S.; providing for
4 physicians and osteopathic physicians to
5 counsel and test certain patients for chronic
6 kidney disease; amending s. 483.181, F.S.;
7 requiring clinical laboratories to provide
8 specified calculations in reports to physicians
9 and osteopathic physicians; providing an
10 effective date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Section 458.3246, Florida Statutes, is
15 created to read:
16 458.3246 Chronic kidney disease; counseling and
17 testing.--A physician licensed under this chapter who is
18 treating a patient with diabetes or hypertension or a patient
19 who has a family history of kidney disease is urged to counsel
20 the patient regarding chronic kidney disease and is urged to
21 test the patient for chronic kidney disease by referring the
22 patient for a routine clinical laboratory assessment of the
23 patient's kidney functions, unless the patient refuses such
24 testing.
25 Section 2. Section 459.0127, Florida Statutes, is
26 created to read:
27 459.0127 Chronic kidney disease; counseling and
28 testing.--An osteopathic physician licensed under this chapter
29 who is treating a patient with diabetes or hypertension or a
30 patient who has a family history of kidney disease is urged to
31 counsel the patient regarding chronic kidney disease and is

1 urged to test the patient for chronic kidney disease by
2 referring the patient for a routine clinical laboratory
3 assessment of the patient's kidney functions, unless the
4 patient refuses such testing.
5 Section 3. Subsection (6) is added to section 483.181,
6 Florida Statutes, to read:
7 483.181 Acceptance, collection, identification, and
8 examination of specimens.--
9 (6) A clinical laboratory licensed under this part
10 that tests a specimen to determine a patient's serum
11 creatinine level, as ordered or prescribed by a practitioner
12 licensed under chapter 458 or chapter 459, shall calculate the
13 patient's glomerular filtration rate using the information
14 provided by the physician or the patient, as applicable. The
15 laboratory shall include the patient's glomerular filtration
16 rate in its report to the physician.
17 Section 4. This act shall take effect July 1, 2006.
