5 Prekindergarten Education Program personnel
6 from refingerprinting or rescreening; amending
7 s. 1002.67, F.S.; requiring curriculum selected
8 or designed by a private prekindergarten
9 provider or a public school to include certain
10 assessments of a student's progress; amending
11 s. 1002.69, F.S.; deleting a restriction with
12 respect to the minimum kindergarten readiness
13 rate adopted by the State Board of Education as
14 satisfactory for a private prekindergarten
15 provider or a public school; providing an
16 effective date.

18 Be It Enacted by the Legislature of the State of Florida:
19
20 Section 1. Section 402.3057, Florida Statutes, is
21 amended to read:
22 402.3057 Persons not required to be refingerprinted or
23 rescreened.--Any provision of law to the contrary
24 notwithstanding, human resource personnel who have been
25 fingerprinted or screened pursuant to chapters 393, 394, 397,
26 402, and 409, and teachers and noninstructional personnel who
27 have been fingerprinted pursuant to chapter 1012 or
28 requirements of the Voluntary Prekindergarten Education
29 Program, who have not been unemployed for more than 90 days
30 thereafter, and who under the penalty of perjury attest to the
31 completion of such fingerprinting or screening and to

1 compliance with the provisions of this section and the
2 standards for good moral character as contained in such
3 provisions as ss. 110.1127(3), 393.0655(1), 394.457(6),
4 397.451, 402.305(2), and 409.175(6), shall not be required to
5 be refingerprinted or rescreened in order to comply with any
6 caretaker screening or fingerprinting requirements.
7 Section 2. Paragraph (a) of subsection (2) of section
8 1002.67, Florida Statutes, is amended to read:
9 1002.67 Performance standards; curricula and
10 accountability.--
11 (2)(a) Each private prekindergarten provider and
12 public school may select or design the curriculum that the
13 provider or school uses to implement the Voluntary
14 Prekindergarten Education Program, except as otherwise
15 required for a provider or school that is placed on probation
16 under paragraph (3)(c). The curriculum selected or designed
17 pursuant to this paragraph must include a curriculum-based
18 preassessment and postassessment for the purpose of
19 determining a student's progress during the program year.
20 Section 3. Subsection (6) of section 1002.69, Florida
21 Statutes, is amended to read:
22 1002.69 Statewide kindergarten screening; kindergarten
23 readiness rates.--
24 (6)(a) The State Board of Education shall periodically
25 adopt a minimum kindergarten readiness rate that, if achieved
26 by a private prekindergarten provider or public school, would
27 demonstrate the provider's or school's satisfactory delivery
28 of the Voluntary Prekindergarten Education Program.
29 (b) The minimum rate must not exceed the rate at which
30 more than 15 percent of the kindergarten readiness rates of
31 all private prekindergarten providers and public schools

1 delivering the Voluntary Prekindergarten Education Program in
2 the state would fall below the minimum rate.
3 Section 4. This act shall take effect July 1, 2006.
