1 A bill to be entitled
2 An act relating to athletic trainers; amending
3 s. 468.707, F.S.; revising the requirements for
4 licensure as an athletic trainer; amending s.
5 468.711, F.S.; revising the criteria for
6 continuing education in athletic training;
7 amending s. 468.723, F.S.; providing that a
8 person employed as an apprentice trainer or
9 athletic trainer is not exempt from part XIII
10 of ch. 468, F.S.; amending s. 1012.46, F.S.;
11 deleting the classification of first responder
12 in a school district's athletic injuries
13 prevention and treatment program; requiring
14 that an athletic trainer employed by a school
15 district be licensed as an athletic trainer;
16 deleting a requirement that such person possess
17 certain certification as an educator; providing
18 an effective date.

20 Be It Enacted by the Legislature of the State of Florida:
21
22 Section 1. Subsection (1) of section 468.707, Florida
23 Statutes, is amended to read:
24 468.707 Licensure by examination; requirements.--
25 (1) Any person desiring to be licensed as an athletic
26 trainer shall apply to the department on a form approved by
27 the department.
28 (a) The department shall license each applicant who:
29 (a)1. Has completed the application form and remitted
30 the required fees.
31 (b)2. Is at least 21 years of age.

1 (c)3. Has obtained a baccalaureate degree from a
2 college or university accredited by an accrediting agency
3 recognized and approved by the United States Department of
4 Education or the Commission on Recognition of Postsecondary
5 Accreditation, or approved by the board.
6 (d)4. Has completed an approved athletic training
7 curriculum coursework from a college or university accredited
8 by an accrediting agency recognized and approved by the United
9 States Department of Education or the Commission on
10 Recognition of Postsecondary Accreditation, or approved by the
11 board, in each of the following areas, as provided by rule:
12 health, human anatomy, kinesiology/biomechanics, human
13 physiology, physiology of exercise, basic athletic training,
14 and advanced athletic training.
15 (e)5. Has current certification in standard first aid
16 and cardiovascular pulmonary resuscitation from the American
17 Red Cross, the American Heart Association, or an equivalent
18 certification as determined by the board.
19 6. Has, within 2 of the preceding 5 years, attained a
20 minimum of 800 hours of athletic training experience under the
21 direct supervision of a licensed athletic trainer or an
22 athletic trainer certified by the National Athletic Trainers'
23 Association or a comparable national athletic standards
24 organization.
25 (f)7. Has passed an examination administered or
26 approved by the board.
27 (b) The department shall also license each applicant
28 who:
29 1. Has completed the application form and remitted the
30 required fees no later than October 1, 1996.
31 2. Is at least 21 years of age.

1 3. Has current certification in standard first aid and
2 cardiovascular pulmonary resuscitation from the American Red
3 Cross or an equivalent certification as determined by the
4 board.
5 4.a. Has practiced athletic training for at least 3 of
6 the 5 years preceding application; or
7 b. Is currently certified by the National Athletic
8 Trainers' Association or a comparable national athletic
9 standards organization.
10 Section 2. Section 468.711, Florida Statutes, is
11 amended to read:
12 468.711 Renewal of license; continuing education.--
13 (1) The department shall renew a license upon receipt
14 of the renewal application and fee, provided the applicant is
15 in compliance with the provisions of this section part,
16 chapter 456, and rules promulgated pursuant thereto.
17 (2) The board may, by rule, prescribe continuing
18 education requirements, not to exceed 24 hours biennially.
19 The criteria for continuing education shall be approved by the
20 board and shall include a current certificate in include 4
21 hours in standard first aid and cardiovascular pulmonary
22 resuscitation from the American Red Cross or equivalent
23 training as determined by the board.
24 (3) Pursuant to the requirements of s. 456.034, each
25 licensee shall complete a continuing education course on human
26 immunodeficiency virus and acquired immune deficiency syndrome
27 as part of biennial relicensure.
28 Section 3. Section 468.723, Florida Statutes, is
29 amended to read:

1 468.723 Exemptions.--Nothing in This part does not
2 prevent or restrict shall be construed as preventing or
3 restricting:
4 (1) The professional practice of a licensee of the
5 department who is acting within the scope of such practice.
6 (2) An athletic training A student athletic trainer
7 acting under the direct supervision of a licensed athletic
8 trainer.
9 (3) A person employed as a teacher apprentice trainer
10 I, a teacher apprentice trainer II, or a teacher athletic
11 trainer under s. 1012.46.
12 (3)(4) A person from administering standard first aid
13 treatment to an athlete.
14 (4)(5) A person licensed under chapter 548, provided
15 such person is acting within the scope of such license.
16 (5)(6) A person providing personal training
17 instruction for exercise, aerobics, or weightlifting, if the
18 person does not represent himself or herself as able to
19 provide "athletic trainer" services and if any recognition or
20 treatment of injuries is limited to the provision of first
21 aid.
22 Section 4. Section 1012.46, Florida Statutes, is
23 amended to read:
24 1012.46 Athletic trainers.--
25 (1) School districts may establish and implement an
26 athletic injuries prevention and treatment program. Central to
27 this program should be the employment and availability of
28 persons trained in the prevention and treatment of physical
29 injuries that which may occur during athletic activities. The
30 program should reflect opportunities for progressive
31 advancement and compensation in employment as provided in

1 subsection (2) and meet certain other minimum standards
2 developed by the Department of Education. The goal of the
3 Legislature is to have school districts employ and have
4 available a full-time teacher athletic trainer in each high
5 school in the state.
6 (2) To the extent practicable, a school district
7 program should include the following employment classification
8 and advancement scheme:
9 (a) First responder.--To qualify as a first responder,
10 a person must possess a professional, temporary, part-time,
11 adjunct, or substitute certificate pursuant to s. 1012.56, be
12 certified in cardiopulmonary resuscitation, first aid, and
13 have 15 semester hours in courses such as care and prevention
14 of athletic injuries, anatomy, physiology, nutrition,
15 counseling, and other similar courses approved by the
16 Commissioner of Education. This person may only administer
17 first aid and similar care.
18 (2)(b) Teacher athletic trainer.--To qualify as an a
19 teacher athletic trainer, a person must be licensed as
20 required by part XIII of chapter 468 and may possess a
21 professional, temporary, part-time, adjunct, or substitute
22 certificate pursuant to s. 1012.35, s. 1012.56, or s. 1012.57,
23 and be licensed as required by part XIII of chapter 468.
24 Section 5. This act shall take effect upon becoming a
25 law.
