1 A bill to be entitled
2 An act relating to driver licenses; amending s.
3 322.18, F.S.; eliminating an age requirement
4 relating to vision tests; requiring a vision
5 test for all renewals of a license; providing
6 for submission of test results by a physician,
7 ophthalmologist, or optometrist; requiring such
8 submission prior to a licensee using certain
9 renewal procedures; limiting the duration of
10 licenses issued to applicants in specified age
11 ranges; amending s. 322.21, F.S.; providing a
12 schedule of reduced renewal fees for persons
13 who must renew specified licenses more
14 frequently due to their age; providing an
15 effective date.

17 Be It Enacted by the Legislature of the State of Florida:
18
19 Section 1. Subsections (2) and (5) of section 322.18,
20 Florida Statutes, are amended, and subsection (10) is added to
21 that section, to read:
22 322.18 Original applications, licenses, and renewals;
23 expiration of licenses; delinquent licenses.--
24 (2) Except as limited by subsection (10), each
25 applicant who is entitled to the issuance of a driver's
26 license, as provided in this section, shall be issued a
27 driver's license, as follows:
28 (a) An applicant applying for an original issuance
29 shall be issued a driver's license which expires at midnight
30 on the licensee's birthday which next occurs on or after the
31 sixth anniversary of the date of issue.

1 (b) An applicant applying for a renewal issuance or
2 renewal extension shall be issued a driver's license or
3 renewal extension sticker which expires at midnight on the
4 licensee's birthday which next occurs 4 years after the month
5 of expiration of the license being renewed, except that a
6 driver whose driving record reflects no convictions for the
7 preceding 3 years shall be issued a driver's license or
8 renewal extension sticker which expires at midnight on the
9 licensee's birthday which next occurs 6 years after the month
10 of expiration of the license being renewed.
11 (c) Notwithstanding any other provision of this
12 chapter, if an applicant establishes his or her identity for a
13 driver's license using a document authorized under s.
14 322.08(2)(c)5., the driver's license shall expire in
15 accordance with paragraph (b). After an initial showing of
16 such documentation, he or she is exempted from having to renew
17 or obtain a duplicate in person.
18 (d) Notwithstanding any other provision of this
19 chapter, if an applicant establishes his or her identity for a
20 driver's license using a document authorized in s.
21 322.08(2)(c)6. or 7., the driver's license shall expire 2
22 years after the date of issuance or upon the expiration date
23 cited on the United States Department of Homeland Security
24 documents, whichever date first occurs.
25 (e) Notwithstanding any other provision of this
26 chapter, an applicant applying for an original or renewal
27 issuance of a commercial driver's license as defined in s.
28 322.01(7), with a hazardous-materials endorsement, pursuant to
29 s. 322.57(1)(e), shall be issued a driver's license that
30 expires at midnight on the licensee's birthday that next

1 occurs 4 years after the month of expiration of the license
2 being issued or renewed.
3 (5) All renewal driver's licenses may be issued after
4 the applicant licensee has been determined to be eligible by
5 the department.
6 (a) A licensee who is otherwise eligible for renewal
7 and who is over 79 years of age:
8 1. Must submit to and pass a vision test administered
9 at any driver's license office; or
10 2. Must, if the licensee applies for an extension by
11 mail as provided in subsection (8), must submit to a vision
12 test administered by a physician or ophthalmologist licensed
13 under chapter 458 or chapter 459, or an optometrist licensed
14 under chapter 463, no more than 6 months prior to the date of
15 the application for extension, must send the results of that
16 test to the department on a form obtained from the department
17 and signed by such health care practitioner, and must meet
18 vision standards that are equivalent to the standards for
19 passing the departmental vision test. The physician,
20 ophthalmologist, or optometrist may submit the results of a
21 vision test by a department-approved electronic means.
22 (b) A licensee who is over 79 years of age may not
23 submit an application for extension under subsection (8) by
24 electronic or telephonic means, unless the results of a vision
25 test have been electronically submitted in advance by the
26 physician, ophthalmologist, or optometrist.
27 (10) Notwithstanding any other provision of this
28 chapter, an applicant 70 years of age or older on the date of
29 application shall receive the original issuance or renewal to
30 which he or she is otherwise entitled, but for no longer than
31 the duration provided in this paragraph. The duration of a

1 license issued to an applicant whose age is within any of the
2 following ranges shall be as follows:
3 (a) At least 70 but less than 80 years old -- 3 years.
4 (b) At least 80 but less than 90 years old -- 2 years.
5 (c) At least 90 years old -- 1 year.
6 Section 2. Paragraph (c) of subsection (1) of section
7 322.21, Florida Statutes, is amended to read:
8 322.21 License fees; procedure for handling and
9 collecting fees.--
10 (1) Except as otherwise provided herein, the fee for:
11 (c) The renewal or extension of a Class E driver's
12 license or of a license restricted to motorcycle use only is
13 based on the duration of the license, as provided in s.
14 322.18(2) and (10), as follows:
15 1. Four or 6 years -- $15.
16 2. Three years -- $7.50.
17 3. Two years -- $5.
18 4. One year -- $2.50.

20 $15, except that A delinquent fee of $1 shall be added for a
21 renewal or extension made not more than 12 months after the
22 license expiration date. The fee provided in this paragraph
23 shall include the fee for driver's education provided by s.
24 1003.48.
25 Section 3. This act shall take effect July 1, 2006.
