  1                      A bill to be entitled

  2         An act relating to the practice of law;

  3         amending s. 454.18, F.S.; permitting deputy

  4         clerks of court and deputy sheriffs who are

  5         employed less than full time to practice law;

  6         making editorial changes; conforming an

  7         exception; providing an effective date.

  9  Be It Enacted by the Legislature of the State of Florida:

10  

11         Section 1.  Section 454.18, Florida Statutes, is

12  amended to read:

13         454.18  Officers not allowed to practice.--No sheriff

14  or clerk of any court, or full-time deputy thereof, shall

15  practice in this state, nor shall any person not of good moral

16  character, or who has been convicted of an infamous crime be

17  entitled to practice. But No person shall be denied the right

18  to practice on account of sex, race, or color. And Any person,

19  whether an attorney or not, or whether within the exceptions

20  mentioned above or not, may conduct his or her own cause in

21  any court of this state, or before any public board,

22  committee, or officer, subject to the lawful rules and

23  discipline of such court, board, committee, or officer. The

24  provisions of this section restricting the practice of law by

25  a sheriff or clerk, or full-time deputy thereof, shall not

26  apply in a case where such person is representing the office

27  or agency in the course of his or her duties as an attorney.

28         Section 2.  This act shall take effect July 1, 2006.
