13         Senate Amendment (with title amendment) 
14         On page 5, between lines 15 and 16,
15  
16  insert:  
17         Section 3.  (1)  Before January 1, 2007, the Department
18  of Environmental Protection must submit to the United States
19  Department of Commerce the provisions of ss. 253.61, 377.06,
20  377.24, and 377.242, Florida Statutes, as substantial changes
21  to the enforceable policies related to uses subject to the
22  Florida Coastal Management Program as authorized under the
23  Coastal Zone Management Act of 1972, as amended, and pursuant
24  to the process set forth in regulations at 15 C.F.R. s.
25  923.80, et seq.
26         (2)  Any activities prohibited by the provisions of ss.
27  253.61, 377.06, 377.24, and 377.242, Florida Statutes, are
28  inconsistent with the Florida Coastal Management Program,
29  unless, because of changed circumstances or new information
30  material to a consistency determination, the Governor and the
31  Cabinet subsequently find upon clear and convincing evidence

14         part of the state's coastal zone management
15         program; providing that the Governor and the
16         Cabinet may make a consistency determination
17         for Florida's Coastal Management Program;
