1 A bill to be entitled
2 An act relating to the North Naples Fire
3 Control and Rescue District, Collier County;
4 amending chapter 99-450, Laws of Florida;
5 providing for the payment of certain taxes and
6 fees and the application of certain regulations
7 and requirements in the event of annexation by
8 a municipality within the boundaries of the
9 district; providing an effective date.

11 Be It Enacted by the Legislature of the State of Florida:

13 Section 1. Section 3 of Article III of section 3 of
14 chapter 99-450, Laws of Florida, is amended to read:
15 ARTICLE III
16 Boundaries of the District
17 Section 3. Section 171.093, Florida Statutes, applies
18 to annexations by a municipality within the boundaries of the
19 district. The annexing municipality shall annually pay the
20 district the equivalent of the premium tax revenues authorized
21 in sections 175.041 and 175.101, Florida Statutes, which are
22 attributable to the annexed properties during the duration and
23 until the later of the expiration of the period provided for
24 in section 171.093(4), Florida Statutes, or the expiration of
25 the interlocal agreement, or any extension of such agreement,
26 as authorized in section 171.093(3), Florida Statutes. During
27 the term of the district's provision of fire protection
28 services to the annexed area, the district's regulations,
29 inspection requirements, and authority to collect inspection
30 fees and impact fees shall apply within the annexed area. In
31 the event that property in the district is annexed by the City

1 of Naples between January 1 and July 1 of any year, the
2 property shall be regarded as removed from the North Naples
3 Fire Control and Rescue District as of January 1 of that year
4 for the purpose of the levy of general ad valorem taxes by the
5 district. If annexation occurs after July 1, the property
6 shall be assessed by the district for ad valorem taxes for
7 that year. On and after the effective date of annexation, the
8 district shall be relieved of providing fire service to the
9 annexed area. The city and the district may reach an agreement
10 to determine what portion, if any, of the existing
11 indebtedness or property of the district shall be assumed by
12 the municipality of which the annexed territory will become a
13 part, the fair value of such indebtedness or property, and the
14 manner of transfer and financing. Nothing herein shall relieve
15 the property annexed from the payment of general obligation
16 debt service incurred by the district before annexation.
17 Section 2. This act shall take effect upon becoming a
18 law.
