  1                      A bill to be entitled

  2         An act relating to the South Broward Drainage

  3         District, Broward County; amending chapter

  4         98-524, Laws of Florida; amending the amount

  5         for which advertisement for bids is required

  6         for the procurement by the district of

  7         contractual services and purchase of goods,

  8         supplies, and materials to comply with state

  9         statutory requirements; providing for recording

10         of the act; providing severability; providing

11         an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Subsection (1) of section 53 of section 2

16  of chapter 98-524, Laws of Florida, is amended to read:

17         Section 53.  Procurement of contractual services and

18  purchase of goods, supplies, and materials.--

19         (1)  All contracts let by the board for professional

20  architectural, engineering, landscape architectural, or land

21  surveying services for any project authorized by chapter

22  98-524, Laws of Florida, as amended, this act shall be in

23  compliance with section s. 287.055, Florida Statutes, as

24  amended. Except as stated herein and as provided by section s.

25  287.055, Florida Statutes, as amended, no contract shall be

26  let by the board for the construction or maintenance of any

27  improvements authorized under chapter 98-524, Laws of Florida,

28  as amended this act, nor shall any goods, supplies, or

29  materials be purchased when the amount thereof to be paid by

30  the district shall exceed the threshold amount provided in

31  section 287.017(1), Florida Statutes, as amended, for CATEGORY

 1  TWO $10,000, unless notice of bids shall be advertised once a

 2  week for 2 consecutive weeks in a newspaper in general

 3  circulation in Broward County, and in each case the bid of the

 4  lowest responsible bidder shall be accepted, unless all bids

 5  are rejected because the bids are too high. The board may

 6  require the bidders to furnish bond with responsible surety to

 7  be approved by the board. Nothing in this section shall

 8  prevent the board from undertaking and performing the

 9  construction, operation, and maintenance of any project,

10  facility, or improvements authorized under chapter 98-524,

11  Laws of Florida, as amended, this act by the employment of

12  labor, material, and machinery.

13         Section 2.  A certified copy of this act shall be

14  recorded in the Broward County Public Records by the South

15  Broward Drainage District.

16         Section 3.  If any provision of this act or the

17  application thereof to any person or circumstance is held

18  invalid, the invalidity shall not affect other provisions or

19  applications of the act which can be given effect without the

20  invalid provision or application, and to this end the

21  provisions of this act are declared severable.

22         Section 4.  This act shall take effect upon becoming a

23  law.
