14 On page 10, lines 18-24, delete those lines
15
16 and insert:
17 (15) If the insurer timely agrees in writing to comply
18 and timely complies with the recommendation of the neutral
19 evaluator, but the policyholder declines to resolve the matter
20 in accordance with the recommendation of the neutral evaluator
21 pursuant to this section:
22 a. The insurer is not liable for extra-contractual
23 damages related to a claim for a sinkhole loss but only as
24 related to the issues determined by the neutral evaluation
25 process. This section does not affect or impair claims for
26 extra contractual damages unrelated to the issues determined
27 by the neutral evaluation process contained in this section;
28 and
29 b. The insurer is not liable for attorney's fees under
30 s. 627.428 or other provisions of the insurance code unless
31 the policyholder obtains a judgment that is more favorable
