13         Senate Amendment 
14         On page 9, line 30, through
15            page 10, line 4, delete those lines
16  
17  and insert:  
18         (13)  The recommendation of the neutral evaluator is
19  not binding on any party, and the parties retain access to
20  court. The neutral evaluator's written recommendation is
21  admissible in any subsequent action or proceeding relating to
22  the claim or to the cause of action giving rise to the claim.
23  The report of the neutral evaluator as to the presence or
24  absence of a sinkhole loss is presumed correct absent clear
25  and convincing evidence to the contrary. The report of the
26  neutral evaluator as to the need for and estimated costs of
27  stabilizing the land and any covered structures or buildings
28  and other appropriate remediation or structural repairs
29  resulting from a sinkhole loss is presumed correct absent a
30  preponderance of the evidence to the contrary. If the findings
31  in the neutral evaluator's written recommendation are
