  1                      A bill to be entitled

  2         An act relating to nursing home facilities;

  3         creating s. 400.0627, F.S.; providing

  4         legislative intent; requiring the Agency for

  5         Health Care Administration to reimburse nursing

  6         home facilities for the cost of building or

  7         modifying their emergency electrical power

  8         systems to fully operate during and after an

  9         emergency; providing eligibility criteria for

10         reimbursement; providing an appropriation;

11         providing an effective date.

13  Be It Enacted by the Legislature of the State of Florida:

14  

15         Section 1.  Section 400.0627, Florida Statutes, is

16  created to read:

17         400.0627  Emergency electric power system capacity.--

18         (1)  It is the intent of the Legislature that each

19  nursing home facility in this state be encouraged to have an

20  emergency electrical power system capacity that is sufficient

21  to remain fully operational during and after an emergency in

22  order to maintain the safety and health of the residents of

23  the nursing home facility and, if necessary, to provide care

24  to residents evacuated from other nursing home facilities.

25         (2)  The Agency for Health Care Administration shall

26  reimburse an eligible nursing home facility for the costs of

27  building or modifying its emergency electrical power system

28  capacity to fully operate the facility during and after an

29  emergency. To be eligible for reimbursement, a nursing home

30  facility must:

 1         (a)  Not have been cited for any class I deficiency

 2  within the 30 months preceding the application for

 3  reimbursement;

 4         (b)  Not be located within the hurricane evacuation

 5  zone of the county in which it is located;

 6         (c)  Have the capacity, as determined by the agency, to

 7  care for residents evacuated from other nursing home

 8  facilities during an emergency; and

 9         (d)  Agree to receive residents who are transferred

10  from other nursing home facilities.

11         (3)  This section does not require a nursing home

12  facility to modify its existing emergency electrical power

13  system capacity.

14         Section 2.  The sum of $          is appropriated from

15  the General Revenue Fund to the Agency for Health Care

16  Administration for the purpose of reimbursing eligible nursing

17  home facilities for the costs of building or modifying their

18  emergency electrical power system capacity to fully operate

19  the facility during and after an emergency during the

20  2006-2007 fiscal year.

21         Section 3.  This act shall take effect upon becoming a

22  law.
