1 A bill to be entitled
2 An act relating to the Lifeline
3 telecommunications service; amending s. 364.10,
4 F.S.; requiring certain state agencies to
5 automatically enroll an eligible consumer in
6 the Lifeline service with the appropriate
7 eligible telecommunications carrier; requiring
8 the Public Service Commission, the Department
9 of Children and Family Services, and the Office
10 of Public Counsel to enter into a memorandum of
11 understanding concerning the automatic
12 enrollment of consumers in Lifeline services;
13 providing an effective date.

15 Be It Enacted by the Legislature of the State of Florida:

17 Section 1. Paragraph (h) of subsection (3) of section
18 364.10, Florida Statutes, is amended to read:
19 364.10 Undue advantage to person or locality
20 prohibited; Lifeline service.--

22 (h)1. By December 31, 2005 2003, each state agency
23 providing that provides benefits to persons eligible for
24 Lifeline service shall undertake, in cooperation with the
25 Department of Children and Family Services, the Department of
26 Education, the commission, the Office of Public Counsel, and
27 telecommunications companies providing Lifeline services, the
28 development of procedures to promote Lifeline participation.
29 2. If a state agency determines that a person is
30 eligible for Lifeline service, the agency must immediately
31 ensure that the person is automatically enrolled in the

1 Lifeline service with the appropriate eligible
2 telecommunications carrier. The commission shall adopt rules
3 providing for an automatic enrollment process in order that
4 eligible customers receive Lifeline service.
5 3. The commission, the Department of Children and
6 Family Services, and the Office of Public Counsel shall enter
7 into a memorandum of understanding establishing the respective
8 duties of the commission, the department, and the public
9 counsel with respect to the automatic enrollment.
10 Section 2. This act shall take effect July 1, 2006.

13 SENATE SUMMARY
14 Requires certain state agencies to automatically enroll
an eligible consumer in the Lifeline telecommunications
15 service with the appropriate eligible telecommunications
carrier. Requires the Public Service Commission, the
16 Department of Children and Family Services, and the
Office of Public Counsel to enter into a memorandum of
17 understanding concerning the automatic enrollment of
consumers in Lifeline services.
