A bill to be entitled
2An act relating to Medicaid services; amending s. 409.905,
3F.S.; increasing the Medicaid reimbursement rates for air
4ambulance transportation to match current Medicare rates;
5providing an effective date.

7Be It Enacted by the Legislature of the State of Florida:

9     Section 1.  Subsection (12) of section 409.905, Florida
10Statutes, is amended to read:
11     409.905  Mandatory Medicaid services.--The agency may make
12payments for the following services, which are required of the
13state by Title XIX of the Social Security Act, furnished by
14Medicaid providers to recipients who are determined to be
15eligible on the dates on which the services were provided. Any
16service under this section shall be provided only when medically
17necessary and in accordance with state and federal law.
18Mandatory services rendered by providers in mobile units to
19Medicaid recipients may be restricted by the agency. Nothing in
20this section shall be construed to prevent or limit the agency
21from adjusting fees, reimbursement rates, lengths of stay,
22number of visits, number of services, or any other adjustments
23necessary to comply with the availability of moneys and any
24limitations or directions provided for in the General
25Appropriations Act or chapter 216.
26     (12)  TRANSPORTATION SERVICES.--The agency shall ensure
27that appropriate transportation services are available for a
28Medicaid recipient in need of transport to a qualified Medicaid
29provider for medically necessary and Medicaid-compensable
30services, provided a client's ability to choose a specific
31transportation provider shall be limited to those options
32resulting from policies established by the agency to meet the
33fiscal limitations of the General Appropriations Act. The agency
34may pay for transportation and other related travel expenses as
35necessary only if these services are not otherwise available.
36Medicaid reimbursement for air ambulance transportation shall be
37paid at the same rates as current Medicare reimbursement for the
38same services.
39     Section 2.  This act shall take effect upon becoming a law.
