11  The Committee on Domestic Security (Wilson) recommended the
12  following amendment:
13  
14         Senate Amendment (with directory and title amendments) 
15         On page 5, lines 9-28, delete those lines
16  
17  and insert:  
18         Section 2.  Section 1009.255, Florida Statutes, is
19  created to read:
20         1009.255  Out-of-state fee exemption.--
21         (1)  A student who meets all of the following
22  requirements may be eligible for an exemption from paying
23  out-of-state fees assessed pursuant to s. 1009.22, s. 1009.23,
24  or s. 1009.24:
25         (a)  The student resided in Florida with a parent for
26  at least 3 consecutive years immediately preceding the date
27  the student received a high school diploma, or its equivalent,
28  and attended a Florida public high school for at least 3
29  consecutive school years during such time.
30         (b)  The student is accepted by and has enrolled in a
31  community college or state university within 12 months after

Florida Senate - 2006 COMMITTEE AMENDMENT Bill No. CS for SB 366 Barcode 724780 1 receiving the high school diploma or its equivalent. 2 (c) The student has submitted an application for the 3 exemption to the Department of Education in the manner 4 prescribed by the department by the deadline established by 5 the department. 6 (2)(a) For the 2006-2007 academic year, the department 7 shall distribute the exemptions in the following manner: 8 1. To the first 1,500 students currently enrolled in a 9 community college or state university who have a cumulative 10 grade point average of at least 2.0 who submit an application 11 to the department and meet the criteria in subsection (1). 12 2. To the top 500 students in academic performance in 13 Florida public high schools who submit an application to the 14 department and meet the criteria in subsection (1). 15 (b) Beginning with the 2007-2008 academic year, the 16 Department of Education shall issue no more than 500 new 17 exemptions per year to the top 500 students in academic 18 performance in Florida public high schools who submit an 19 application to the department and meet the criteria in 20 subsection (1). 21 (c) In order to retain the exemption, a student must 22 complete at least 12 semester credit hours or the equivalent 23 in the previous academic year and maintain at least a 2.0 24 cumulative grade point average. 25 (3)(a) The Department of Education shall administer 26 the exemption program, develop an application form, and 27 establish deadlines and guidelines for student participation. 28 (b) The department shall issue the exemptions by 29 August 31 of each year and shall notify the student and the 30 community college or state university in which the student is 31 enrolled. 2 8:12 AM 04/18/06 s0366c1c-ds33-b01
