| 7 | the use of eminent domain; providing an effective date. |

| 9 | Be It Enacted by the Legislature of the State of Florida: |
| 10 |

| 11 | Section 1. A government entity, in exercising the power of |
| 12 | eminent domain otherwise conferred by law, may not take private |
| 13 | property for the sole purpose of developing it for the benefit |
| 14 | of a private party if no economic benefit is provided to the |
| 15 | public. As used in this section, the term "government entity" |
| 16 | means a state agency, political subdivision, or private |
| 17 | corporation acting on behalf of a state agency or political |
| 18 | subdivision. |
| 19 | Section 2. This act shall take effect July 1, 2006. |
