18 Section 3. Subsections (28) and (31) of section
19 499.003, Florida Statutes, are amended to read:
20 499.003 Definitions of terms used in ss.
21 499.001-499.081.--As used in ss. 499.001-499.081, the term:
22 (28) "Manufacturer" means a person who prepares,
23 derives, manufactures, or produces a drug, device, or
24 cosmetic. The term excludes pharmacies that are operating in
25 compliance with pharmacy practice standards as defined in
26 chapter 465 and rules adopted under that chapter. This term
27 also means the holder of an approved new drug application,
28 abbreviated new drug application, or new animal drug
29 application; a private label distributor if the private label
30 distributor's prescription drugs are originally manufactured
31 and labeled for the distributor and have not been repackaged;

1 or the distribution point establishment for the manufacturer,
2 contract manufacturer, or private label distributor, whether
3 the establishment is a member of the manufacturer's affiliated
4 group or is a contract distribution site, only to the extent
5 that the contract distribution distributes the drugs of the
6 manufacturer.
