  1                      A bill to be entitled

  2         An act relating to trust funds; creating the

  3         Florida Wild-Caught Food Shrimp Economic

  4         Development Trust Fund within the Fish and

  5         Wildlife Conservation Commission; providing for

  6         sources of funds and purposes; providing for

  7         future review and termination or re-creation of

  8         the trust fund; providing a contingent

  9         effective date.

11  Be It Enacted by the Legislature of the State of Florida:

12  

13         Section 1.  Florida Wild-Caught Food Shrimp Economic

14  Development Trust Fund.--

15         (1)  There is created the Florida Wild-Caught Food

16  Shrimp Economic Development Trust Fund within the Fish and

17  Wildlife Conservation Commission.  The purpose of the trust

18  fund is to receive funds collected by the commission from the

19  annual fee imposed on individuals, firms, and corporations

20  engaged in the commercial taking of Florida wild-caught food

21  shrimp. Moneys in the trust fund shall be used for the purpose

22  of protecting and promoting markets for Florida wild-caught

23  food shrimp.

24         (2)  In accordance with s. 19(f)(2), Art. III of the

25  State Constitution, the trust fund must, unless terminated

26  sooner, be terminated on July 1, 2010.  Before its scheduled

27  termination, the trust fund must be reviewed as provided in s.

28  215.3206(1) and (2), Florida Statutes.

29         Section 2.  This act shall take effect on the effective

30  date of Senate Bill ____, or similar legislation, but it shall

31  not take effect unless it is enacted by a three-fifths vote of

 1  the membership of each house of the Legislature and unless

 2  Senate Bill ____, or similar legislation, becomes law.
