1 A bill to be entitled
2 An act relating to continued employment
3 requirements for law enforcement personnel;
4 amending s. 943.135, F.S.; revising the
5 presumption of disability for certain law
6 enforcement, correctional, and correctional
7 probation officers for purposes of workers'
8 compensation and authorizing establishment of
9 tobacco-use standards; providing an effective
10 date.

12 Be It Enacted by the Legislature of the State of Florida:

14 Section 1. Subsections (5) and (6) are added to
15 section 943.135, Florida Statutes, to read:
16 943.135 Requirements for continued employment.--
17 (5) An employing agency as defined in s. 943.10 may
18 require a law enforcement officer, correctional officer, or
19 correctional probation officer as defined in s. 943.10 who is
20 employed full time to successfully pass a physical examination
21 in order to be eligible for the presumption set forth in s.
22 112.18. The employing agency shall have the physical
23 examination performed prior to or immediately upon employment
24 of the officer. This provision shall not affect the
25 applicability of the presumption set forth in s. 112.18 for
26 law enforcement officers, correctional officers, or
27 correctional probation officers who are currently employed by
28 an employing agency.
29 (6) An employing agency as defined in s. 943.10 may
30 set tobacco-use standards for law enforcement officers,

1 correctional officers, and correctional probation officers as
2 defined in s. 943.10 who are employed full time.
3 Section 2. This act shall take effect October 1, 2006.
