  1                      A bill to be entitled

  2         An act relating to cardrooms; amending s.

  3         849.086, F.S.; deleting a provision authorizing

  4         cardrooms to operate only during authorized

  5         pari-mutuel events; deleting an exception that

  6         allows pari-mutuel permitholders to operate

  7         cardrooms on certain days when they are not

  8         holding pari-mutuel events; providing hours of

  9         operation for cardrooms at any horserace,

10         greyhound, or jai alai facility that conducted

11         a full schedule of racing or games in the

12         preceding year; providing an effective date.

14  Be It Enacted by the Legislature of the State of Florida:

15  

16         Section 1.  Paragraph (b) of subsection (7) of section

17  849.086, Florida Statutes, is amended to read:

18         849.086  Cardrooms authorized.--

19         (7)  CONDITIONS FOR OPERATING A CARDROOM.--

20         (b)  Any horserace, greyhound, or jai alai permitholder

21  licensed under this chapter may operate a cardroom at the

22  pari-mutuel facility on any day between the hours of 12 noon

23  and 12 midnight if the permitholder conducted a full schedule

24  of live racing or games in the preceding year. A cardroom may

25  be operated at the facility only when the facility is

26  authorized to accept wagers on pari-mutuel events during its

27  authorized meet. A cardroom may operate between the hours of

28  12 noon and 12 midnight on any day a pari-mutuel event is

29  conducted live as a part of its authorized meet. However, a

30  permitholder who holds a valid cardroom license may operate a

31  cardroom between the hours of 12 noon and 12 midnight on any

 1  day that live racing of the same class of permit is occurring

 2  within 35 miles of its facility if no other holder of that

 3  same class of permit within 35 miles is operating a cardroom

 4  at such time and if all holders of the same class of permit

 5  within the 35-mile area have given their permission in writing

 6  to the permitholder to operate the cardroom during the

 7  designated period. Application to operate a cardroom under

 8  this paragraph must be made to the division as part of the

 9  annual license application.

10         Section 2.  This act shall take effect July 1, 2006.

13                          SENATE SUMMARY

14    Deletes a provision that cardrooms may be operated only
      during authorized pari-mutuel events.  Deletes an
15    exception that allows pari-mutuel permitholders to
      operate cardrooms on certain days when they are not
16    holding pari-mutuel events.  Provides hours of operation
      for cardrooms at any horserace, greyhound, or jai alai
17    facility that conducted a full schedule of racing or
      games in the preceding year.
