17 Section 1. Council on the Social Status of Black Men
18 and Boys.--
19 (1) The Council on the Social Status of Black Men and
20 Boys is established within the Department of Legal Affairs and
21 shall consist of 19 members appointed as follows:
22 (a) Two members of the Senate who are not members of
23 the same political party, appointed by the President of the
24 Senate with the advice of the Minority Leader of the Senate.
25 (b) Two members of the House of Representatives who
26 are not members of the same political party, appointed by the
27 Speaker of the House of Representatives with the advice of the
28 Minority Leader of the House of Representatives.
29 (c) The Secretary of Children and Family Services or
30 his or her designee.
31 (d) The director of the Mental Health Program Office

1 within the Department of Children and Family Services or his
2 or her designee.
3 (e) The Secretary of Health or his or her designee.
4 (f) The Commissioner of Education or his or her
5 designee.
6 (g) The Secretary of Corrections or his or her
7 designee.
8 (h) The Attorney General or his or her designee.
9 (i) The Secretary of Management Services or his or her
10 designee.
11 (j) The director of the Agency for Workforce
12 Innovation or his or her designee.
13 (k) A businessperson of black origin appointed by the
14 Governor.
15 (l) Two persons appointed by the President of the
16 Senate who are not members of the Legislature or employed by
17 state government. One of the appointees must be a clinical
18 psychologist.
19 (m) Two persons appointed by the Speaker of the House
20 of Representatives who are not members of the Legislature or
21 employed by state government. One of the appointees must be an
22 Africana studies professional.
23 (n) The deputy secretary for Medicaid in the Agency
24 for Health Care Administration or his or her designee.
25 (o) The Secretary of Juvenile Justice or his or her
26 designee.
27 (2) Each member of the council shall be appointed to a
28 4-year term; however, for the purpose of providing staggered
29 terms, of the initial appointments, 9 members shall be
30 appointed to 2-year terms and 10 members shall be appointed to
31 4-year terms. A member of the council may be removed at any

1 time by the member's appointing authority who shall fill the
2 vacancy on the council.
3 (3)(a) At the first meeting of the council each year,
4 the members shall elect a chair and a vice chair.
5 (b) A vacancy in the office of chair or vice chair
6 shall be filled by vote of the remaining members.
7 (4)(a) The council shall make a systematic study of
8 the conditions affecting black men and boys, including, but
9 not limited to, homicide rates, arrest and incarceration
10 rates, poverty, violence, drug abuse, death rates, disparate
11 annual income levels, school performance in all grade levels
12 including postsecondary levels, and health issues.
13 (b) The council shall propose measures to alleviate
14 and correct the underlying causes of the conditions described
15 in paragraph (a). These measures may consist of changes to the
16 law or systematic changes that can be implemented without
17 legislative action.
18 (c) The council may study other topics suggested by
19 the Legislature or as directed by the chair of the council.
20 (d) The council shall receive suggestions or comments
21 pertinent to the applicable issues from members of the
22 Legislature, governmental agencies, public and private
23 organizations, and private citizens.
24 (5) The Office of the Attorney General shall provide
25 staff and administrative support to the council.
26 (6) The council shall meet quarterly and at other
27 times at the call of the chair or as determined by a majority
28 of council members and approved by the Attorney General.
29 (7) Eleven of the members of the council shall
30 constitute a quorum, and an affirmative vote of a majority of
31 the members present is required for final action.

1 (8)(a) The council shall issue its first annual report
2 by December 15, 2007, and by December 15 each following year,
3 stating the findings, conclusions, and recommendations of the
4 council. The council shall submit the report to the Governor,
5 the President of the Senate, the Speaker of the House of
6 Representatives, and the chairpersons of the standing
7 committees of jurisdiction in each chamber.
8 (b) The initial report must include the findings of an
9 investigation into factors causing black-on-black crime from
10 the perspective of public health related to mental health,
11 other health issues, cultural disconnection, and cultural
12 identity trauma.
13 (9) Members of the council shall serve without
14 compensation. Members are entitled to reimbursement for per
15 diem and travel expenses as provided in s. 112.061, Florida
16 Statutes. State officers and employees shall be reimbursed
17 from the budget of the agency through which they serve. Other
18 members may be reimbursed by the Department of Legal Affairs.
19 (10) The council and any subcommittees it forms shall
20 be subject to the provisions of chapter 119, Florida Statutes,
21 related to public records, and the provisions of chapter 286,
22 Florida Statutes, related to public meetings.
23 (11) Each member of the council who is not otherwise
24 required to file a financial disclosure statement pursuant to
25 s. 8, Art. II of the State Constitution or s. 112.3144,
26 Florida Statutes, must file a disclosure of financial
27 interests pursuant to s. 112.3145, Florida Statutes.
28 (12) Notwithstanding subsection (6), the Attorney
29 General shall:
30 (a) Within 60 days after the effective date of this
31 act, fix a date for the initial meeting of the council.

1 (b) Notify each member of the council of the time,
2 date, and place where the initial meeting will be held.
3 (c) Make any other arrangements concerning the initial
4 meeting of the council.
5 (d) Serve as the presiding officer at the initial
6 meeting of the council until a chair is elected.
7 (13) This section expires July 1, 2012, unless
8 reenacted by the Legislature.
9 Section 2. This act shall take effect January 1, 2007.
