1 A bill to be entitled
2 An act relating to nursing; amending s.
3 464.012, F.S.; requiring that a portion of the
4 nursing license fee be transferred to the
5 Florida Center for Nursing Trust Fund; amending
6 s. 464.0195, F.S.; revising the goals for the
7 Florida Center for Nursing to include the
8 development of a survey and the submission of
9 data; amending s. 464.0196, F.S.; revising the
10 membership of the board of directors of the
11 Florida Center for Nursing; revising the terms
12 of appointment for the board of directors;
13 amending s. 464.0198, F.S.; providing a
14 cross-reference to conform to changes made by
15 the act; providing an effective date.

17 Be It Enacted by the Legislature of the State of Florida:
18
19 Section 1. Subsection (5) of section 464.012, Florida
20 Statutes, is amended to read:
21 464.012 Certification of advanced registered nurse
22 practitioners; fees.--
23 (5) The board shall certify, and the department shall
24 issue a certificate to, any nurse meeting the qualifications
25 in this section. The board shall establish an application fee
26 not to exceed $100 and a biennial renewal fee not to exceed
27 $50. The sum of $5 from each nursing license fee shall be
28 transferred to the Florida Center for Nursing Trust Fund for
29 continuous funding of the center and expanded activities as
30 needed. The board may is authorized to adopt such other rules

1 as are necessary to administer implement the provisions of
2 this section.
3 Section 2. Section 464.0195, Florida Statutes, is
4 amended to read:
5 464.0195 Florida Center for Nursing; goals.--
6 (1) There is established the Florida Center for
7 Nursing to address issues of supply and demand for nursing,
8 including issues of recruitment, retention, and utilization of
9 nurse workforce resources. The Legislature finds that the
10 center will repay the state's investment by providing an
11 ongoing strategy for the allocation of the state's resources
12 directed towards nursing.
13 (2) The primary goals for the center shall be to:
14 (a) Develop a strategic statewide plan for nursing
15 manpower in this state by:
16 1. Establishing and maintaining a database on nursing
17 supply and demand in the state, to include current supply and
18 demand, and future projections; and
19 2. Developing a survey from the Board of Nursing as
20 part of each application and biennial renewal as a registered
21 nurse or licensed practical nurse;
22 3. Submitting survey data to the center for analysis
23 and workforce planning; and
24 4.2. Selecting from the statewide plan priorities to
25 be addressed.
26 (b) Convene various groups representative of nurses,
27 other health care providers, business and industry, consumers,
28 legislators, and educators to:
29 1. Review and comment on data analysis prepared for
30 the center;

1 2. Recommend systemic changes, including strategies
2 for implementation of recommended changes; and
3 3. Evaluate and report the results of these efforts to
4 the Legislature and others.
5 (c) Enhance and promote recognition, reward, and
6 renewal activities for nurses in the state by:
7 1. Promoting nursing excellence programs such as
8 magnet recognition by the American Nurses Credentialing
9 Center;
10 2. Proposing and creating additional reward,
11 recognition, and renewal activities for nurses; and
12 3. Promoting media and positive image-building efforts
13 for nursing.
14 (3) The Board of Nursing shall include on its initial
15 and renewal application forms a question asking the nurse to
16 voluntarily contribute to funding the Florida Center for
17 Nursing in addition to paying the fees imposed at the time of
18 licensure and licensure renewal. Revenues collected from
19 nurses over and above the required fees shall be transferred
20 from the Medical Quality Assurance Trust Fund to the Florida
21 Center for Nursing Trust Fund and shall be used solely to
22 support and maintain the goals and functions of the center.
23 Section 3. Subsections (1) and (2) of section
24 464.0196, Florida Statutes, are amended to read:
25 464.0196 Florida Center for Nursing; board of
26 directors.--
27 (1) The Florida Center for Nursing shall be governed
28 by a policy-setting board of directors. The board shall
29 consist of 16 members, with a simple majority of the board
30 being nurses representative of various practice areas. Other
31 members shall include representatives of other health care

1 professions, business and industry, health care providers, and
2 consumers. The members of the board shall be appointed by the
3 Governor as follows:
4 (a) A registered nurse recommended by the Florida
5 Organization of Nurse Executives;
6 (b) One representative of the hospital industry
7 recommended by the Florida Hospital Association;
8 (c) A registered nurse recommended by the Florida
9 Nurses Association;
10 (d) One representative of the long-term care industry
11 recommended by the Florida Health Care Association and the
12 Florida Association of Homes for the Aged;
13 (e) A dean from a College of Nursing recommended by
14 the Florida Association of Colleges of Nursing;
15 (f) A director of a nursing program in a community
16 college recommended by the Florida Council of Nursing
17 Education Administrators;
18 (g) Two representatives recommended by the Speaker of
19 the House of Representatives;
20 (h) Two representatives recommended by the President
21 of the Senate;
22 (i) Two nurse educators recommended by the
23 Commissioner of the Board of Education; and
24 (j) Four representatives appointed by the Governor,
25 two of whom must be registered nurses.
26 (a) Four members recommended by the President of the
27 Senate, at least one of whom shall be a registered nurse
28 recommended by the Florida Organization of Nurse Executives
29 and at least one other representative of the hospital industry
30 recommended by the Florida Hospital Association;

1 (b) Four members recommended by the Speaker of the
2 House of Representatives, at least one of whom shall be a
3 registered nurse recommended by the Florida Nurses Association
4 and at least one other representative of the long-term care
5 industry;
6 (c) Four members recommended by the Governor, two of
7 whom shall be registered nurses; and
8 (d) Four nurse educators recommended by the State
9 Board of Education, one of whom shall be a dean of a College
10 of Nursing at a state university, one other shall be a
11 director of a nursing program in a state community college.
12 (2) All The initial terms of the members shall be
13 appointed to terms of 3 years and a member may not serve more
14 than 2 consecutive terms. as follows:
15 (a) Of the members appointed pursuant to paragraph
16 (1)(a), two shall be appointed for terms expiring June 30,
17 2005, one for a term expiring June 30, 2004, and one for a
18 term expiring June 30, 2003.
19 (b) Of the members appointed pursuant to paragraph
20 (1)(b), one shall be appointed for a term expiring June 30,
21 2005, two for terms expiring June 30, 2004, and one for a term
22 expiring June 20, 2003.
23 (c) Of the members appointed pursuant to paragraph
24 (1)(c), one shall be appointed for a term expiring June 30,
25 2005, one for a term expiring June 30, 2004, and two for terms
26 expiring June 30, 2003.
27 (d) Of the members appointed pursuant to paragraph
28 (1)(d), the terms of two members recommended by the State
29 Board of Education shall expire June 30, 2005; the term of the
30 member who is a dean of a College of Nursing at a state
31 university shall expire June 30, 2004; and the term of the

1 member who is a director of a state community college nursing
2 program shall expire June 30, 2003.

4 After the initial appointments expire, the terms of all the
5 members shall be for 3 years, with no member serving more than
6 two consecutive terms.
7 Section 4. Subsection (1) of section 464.0198, Florida
8 Statutes, is amended to read:
9 464.0198 Florida Center for Nursing Trust Fund.--
10 (1) There is created the Florida Center for Nursing
11 Trust Fund to be administered by the Department of Health.
12 Funds provided pursuant to ss. 464.012(5) and s. 464.0195(3)
13 for the Florida Center for Nursing shall be deposited into
14 this trust fund. Other funds from grants and donations,
15 federal funds, or other funds from other sources specified by
16 law may be deposited into this trust fund and used for
17 purposes of the Florida Center for Nursing. Moneys deposited
18 into this trust fund shall be used as provided in s. 464.0195.
19 The trust fund is exempt from the service charges imposed by
20 s. 215.20.
21 Section 5. This act shall take effect upon becoming a
22 law.
