1 A bill to be entitled
2 An act relating to nursing; amending s.
3 464.0195, F.S.; revising the goals for the
4 Florida Center for Nursing to include the
5 collection and submission of workforce planning
6 data; amending s. 464.0196, F.S.; revising the
7 membership of the board of directors of the
8 Florida Center for Nursing; revising the terms
9 of appointment for the board of directors;
10 providing an effective date.

12 Be It Enacted by the Legislature of the State of Florida:
13
14 Section 1. Section 464.0195, Florida Statutes, is
15 amended to read:
16 464.0195 Florida Center for Nursing; goals.--
17 (1) There is established the Florida Center for
18 Nursing to address issues of supply and demand for nursing,
19 including issues of recruitment, retention, and utilization of
20 nurse workforce resources. The Legislature finds that the
21 center will repay the state's investment by providing an
22 ongoing strategy for the allocation of the state's resources
23 directed towards nursing.
24 (2) The primary goals for the center shall be to:
25 (a) Develop a strategic statewide plan for nursing
26 manpower in this state by:
27 1. Establishing and maintaining a database on nursing
28 supply and demand in the state, to include current supply and
29 demand, and future projections. The Board of Nursing shall
30 incorporate the collection of workforce planning data as part
31 of each application for licensure and biennial licensure

1 renewal as an advanced registered nurse practitioner,
2 registered nurse, and licensed practical nurse. Data shall be
3 submitted to the center for analysis and workforce planning;
4 and
5 2. Selecting from the plan priorities to be addressed.
6 (b) Convene various groups representative of nurses,
7 other health care providers, business and industry, consumers,
8 legislators, and educators to:
9 1. Review and comment on data analysis prepared for
10 the center;
11 2. Recommend systemic changes, including strategies
12 for implementation of recommended changes; and
13 3. Evaluate and report the results of these efforts to
14 the Legislature and others.
15 (c) Enhance and promote recognition, reward, and
16 renewal activities for nurses in the state by:
17 1. Promoting nursing excellence programs such as
18 magnet recognition by the American Nurses Credentialing
19 Center;
20 2. Proposing and creating additional reward,
21 recognition, and renewal activities for nurses; and
22 3. Promoting media and positive image-building efforts
23 for nursing.
24 (3) The Board of Nursing shall include on its initial
25 and renewal application forms a question asking the nurse to
26 voluntarily contribute to funding the Florida Center for
27 Nursing in addition to paying the fees imposed at the time of
28 licensure and licensure renewal. Revenues collected from
29 nurses over and above the required fees shall be transferred
30 from the Medical Quality Assurance Trust Fund to the Florida

1 Center for Nursing Trust Fund and shall be used solely to
2 support and maintain the goals and functions of the center.
3 Section 2. Subsections (1) and (2) of section
4 464.0196, Florida Statutes, are amended to read:
5 464.0196 Florida Center for Nursing; board of
6 directors.--
7 (1) The Florida Center for Nursing shall be governed
8 by a policy-setting board of directors. The board shall
9 consist of 16 members, with a simple majority of the board
10 being nurses representative of various practice areas. Other
11 members shall include representatives of other health care
12 professions, business and industry, health care providers, and
13 consumers. The members of the board shall be appointed by the
14 Governor as follows:
15 (a) A registered nurse recommended by the Florida
16 Organization of Nurse Executives;
17 (b) One representative of the hospital industry
18 recommended by the Florida Hospital Association;
19 (c) A registered nurse recommended by the Florida
20 Nurses Association;
21 (d) One representative of the long-term care industry
22 recommended by the Florida Health Care Association and the
23 Florida Association of Homes for the Aged;
24 (e) A dean from a College of Nursing recommended by
25 the Florida Association of Colleges of Nursing;
26 (f) A director of a nursing program in a community
27 college recommended by the Florida Council of Nursing
28 Education Administrators;
29 (g) Two representatives recommended by the Speaker of
30 the House of Representatives;

1 (h) Two representatives recommended by the President
2 of the Senate;
3 (i) Two nurse educators recommended by the
4 Commissioner of the Board of Education; and
5 (j) Four representatives appointed by the Governor,
6 two of whom must be registered nurses and one of whom must be
7 a certified registered nurse anesthetist.
8 (a) Four members recommended by the President of the
9 Senate, at least one of whom shall be a registered nurse
10 recommended by the Florida Organization of Nurse Executives
11 and at least one other representative of the hospital industry
12 recommended by the Florida Hospital Association;
13 (b) Four members recommended by the Speaker of the
14 House of Representatives, at least one of whom shall be a
15 registered nurse recommended by the Florida Nurses Association
16 and at least one other representative of the long-term care
17 industry;
18 (c) Four members recommended by the Governor, two of
19 whom shall be registered nurses; and
20 (d) Four nurse educators recommended by the State
21 Board of Education, one of whom shall be a dean of a College
22 of Nursing at a state university, one other shall be a
23 director of a nursing program in a state community college.
24 (2) All The initial terms of the members shall be
25 appointed to terms of 3 years and a member may not serve more
26 than 2 consecutive terms. Beginning July 1, 2006, each current
27 member of the board shall be replaced with a new member upon
28 the expiration of his or her term. Current members who have
29 served only one term may be appointed for a final term. as

1 (a) Of the members appointed pursuant to paragraph
2 (1)(a), two shall be appointed for terms expiring June 30,
3 2005, one for a term expiring June 30, 2004, and one for a
4 term expiring June 30, 2003.
5 (b) Of the members appointed pursuant to paragraph
6 (1)(b), one shall be appointed for a term expiring June 30,
7 2005, two for terms expiring June 30, 2004, and one for a term
8 expiring June 20, 2003.
9 (c) Of the members appointed pursuant to paragraph
10 (1)(c), one shall be appointed for a term expiring June 30,
11 2005, one for a term expiring June 30, 2004, and two for terms
12 expiring June 30, 2003.
13 (d) Of the members appointed pursuant to paragraph
14 (1)(d), the terms of two members recommended by the State
15 Board of Education shall expire June 30, 2005; the term of the
16 member who is a dean of a College of Nursing at a state
17 university shall expire June 30, 2004; and the term of the
18 member who is a director of a state community college nursing
19 program shall expire June 30, 2003.

21 After the initial appointments expire, the terms of all the
22 members shall be for 3 years, with no member serving more than
23 two consecutive terms.
24 Section 3. This act shall take effect upon becoming a
25 law.

COMMITTEE SUBSTITUTE FOR
2 Senate Bill 480

4 The bill no longer provides for additional funding from
certain nursing licensure fees to be transferred to the
5 Florida Center for Nursing Trust Fund. The bill requires the
Board of Nursing to collect workforce planning data in
6 connection with nurse licensure and licensure renewal and to
provide such data to the Florida Center for Nursing for
7 analysis and workforce planning. The bill revises requirements
for the appointment and terms of members of the Board of
8 Directors of the Florida Center for Nursing.
