A bill to be entitled
2An act relating to the Florida Center for Nursing;
3amending s. 464.0195, F.S.; requiring the Florida Center
4for Nursing and the Board of Nursing to develop a
5specified survey to further the center's goals; requiring
6the board to transfer a specified sum of each nursing
7licensure and licensure renewal fee to the Florida Center
8for Nursing Trust Fund for specified uses; providing fee
9limitations on the board; amending s. 464.0196, F.S.;
10revising membership and term-limit criteria for the
11center's board of directors; providing an effective date.

13Be It Enacted by the Legislature of the State of Florida:

15     Section 1.  Paragraph (a) of subsection (2) and subsection
16(3) of section 464.0195, Florida Statutes, are amended to read:
17     464.0195  Florida Center for Nursing; goals.--
18     (2)  The primary goals for the center shall be to:
19     (a)  Develop a strategic statewide plan for nursing
20manpower in this state by:
21     1.  Establishing and maintaining a database on nursing
22supply and demand in the state, to include current supply and
23demand, and future projections; and
24     2.  Selecting from the plan priorities to be addressed;
25and.
26     3.  Working with the Board of Nursing to develop a survey
27as part of each registered nurse and licensed practical nurse
28application for licensure and biennial licensure renewal. Survey
29data shall be submitted to the center for analysis and workforce
30planning.
31     (3)(a)  The Board of Nursing shall include on its initial
32and renewal application forms a question asking the nurse to
33voluntarily contribute to funding the Florida Center for Nursing
34in addition to paying the fees imposed at the time of licensure
35and licensure renewal. Revenues collected from nurses over and
36above the required fees shall be transferred from the Medical
37Quality Assurance Trust Fund to the Florida Center for Nursing
38Trust Fund and shall be used solely to support and maintain the
39goals and functions of the center.
40     (b)  The Board of Nursing shall transfer $5 of each nursing
41licensure and licensure renewal fee to the Florida Center for
42Nursing Trust Fund which shall be used to support, maintain, and
43expand the goals and functions of the center. The Board of
44Nursing shall not increase nursing licensure and licensure
45renewal fees as a result of the requirements of this paragraph.
46     Section 2.  Subsections (1) and (2) of section 464.0196,
47Florida Statutes, are amended to read:
48     464.0196  Florida Center for Nursing; board of directors.--
49     (1)  The Florida Center for Nursing shall be governed by a
50policy-setting board of directors. The board shall consist of 16
51members, with a simple majority of the board being nurses
52representative of various practice areas. Other members shall
53include representatives of other health care professions,
54business and industry, health care providers, and consumers. The
55members of the board shall be appointed by the Governor as
56follows:
57     (a)  One member recommended by the Florida Organization of
58Nurse Executives shall be a registered nurse. Four members
59recommended by the President of the Senate, at least one of whom
60shall be a registered nurse recommended by the Florida
61Organization of Nurse Executives and at least one other
62representative of the hospital industry recommended by the
63Florida Hospital Association;
64     (b)  One member recommended by the Florida Hospital
65Association shall be a representative of the hospital industry.
66Four members recommended by the Speaker of the House of
67Representatives, at least one of whom shall be a registered
68nurse recommended by the Florida Nurses Association and at least
69one other representative of the long-term care industry;
70     (c)  One member recommended by the Florida Nurses
71Association shall be a registered nurse. Four members
72recommended by the Governor, two of whom shall be registered
73nurses; and
74     (d)  One member jointly recommended by the Florida Health
75Care Association and the Florida Association of Homes for the
76Aging shall be a representative of the long-term care industry
77Four nurse educators recommended by the State Board of
78Education, one of whom shall be a dean of a College of Nursing
79at a state university, one other shall be a director of a
80nursing program in a state community college.
81     (e)  One member recommended by the Florida Association of
82Colleges of Nursing shall be a dean of a college of nursing.
83     (f)  One member recommended by the Florida Council of
84Nursing Education Administrators shall be a director of a
85nursing program in a community college.
86     (g)  Two members recommended by the Speaker of the House of
87Representatives.
88     (h)  Two members recommended by the President of the
89Senate.
90     (i)  Two members recommended by the Commissioner of
91Education shall be nurse educators.
92     (j)  Four members recommended by the Governor, two of whom
93shall be registered nurses.
94     (2)  Beginning July 1, 2006, each current member of the
95board shall be replaced with a new member upon the expiration of
96his or her term. The terms of all members appointed on or after
97July 1, 2006, shall be for 3 years, and no such member may serve
98more than two consecutive terms. Current members who have served
99only one term may be appointed for a final 3-year term. The
100initial terms of the members shall be as follows:
101     (a)  Of the members appointed pursuant to paragraph (1)(a),
102two shall be appointed for terms expiring June 30, 2005, one for
103a term expiring June 30, 2004, and one for a term expiring June
10430, 2003.
105     (b)  Of the members appointed pursuant to paragraph (1)(b),
106one shall be appointed for a term expiring June 30, 2005, two
107for terms expiring June 30, 2004, and one for a term expiring
108June 20, 2003.
109     (c)  Of the members appointed pursuant to paragraph (1)(c),
110one shall be appointed for a term expiring June 30, 2005, one
111for a term expiring June 30, 2004, and two for terms expiring
112June 30, 2003.
113     (d)  Of the members appointed pursuant to paragraph (1)(d),
114the terms of two members recommended by the State Board of
115Education shall expire June 30, 2005; the term of the member who
116is a dean of a College of Nursing at a state university shall
117expire June 30, 2004; and the term of the member who is a
118director of a state community college nursing program shall
119expire June 30, 2003.

121After the initial appointments expire, the terms of all the
122members shall be for 3 years, with no member serving more than
123two consecutive terms.
124     Section 3.  This act shall take effect July 1, 2006.
